Legal and ethical aspects of surrogate motherhood

Abstract:

Autorka se v práci zabývá náhradním mateřstvím jako jednou z metod asistované reprodukce. Po historickém exkurzu a teoretickém úvodu do problematiky asistované reprodukce a náhradního mateřství je práce následně zaměřena na hlavní subjekty účastnící se procesu náhradního mateřství – objednatelský pár, náhradní matku a dítě. Ve vztahu k dotčeným subjektům jsou definovány a analyzovány související etické a právní otázky, jako jsou povaha a hranice práva na rodičovství, charakter vztahu mezi objednatelským párem a náhradní matkou, problematika připuštění komercionalizace lidského těla a související otázky komodifikace a exploatace, problematické momenty, k nimž může dojít v souvislosti s předáním dítěte do péče objednatelského páru a založením právního rodičovství včetně dopadu do statusového postavení dítěte a jeho základních lidských práv apod. Na základě rozboru výše uvedených etických a právních aspektů je poté posuzována adekvátnost platné české právní úpravy s ohledem na specifika náhradního mateřství, případně jsou navrhovány úpravy de lege ferenda, jež by dotčeným subjektům mohly přinést vyšší míru právní ochrany.

Abstract:

The author deals with the surrogacy as one of the methods of the assisted reproduction. After historical excursion and theoretical introduction into problematics of the assisted reproduction and the surrogate motherhood, the thesis is subsequently focused on main subjects participating in the process of the surrogate motherhood – an ordering couple, a surrogate mother and a child. Related ethical and legal questions are defined and analyzed in relation to the subjects concerned, such as nature and limits of the right to parenthood, nature of the relationship between an ordering couple and a surrogate mother, issue of allowing commercialization of the human body and related questions of commodification and exploitation, problematic moments that may occur in connection with handing over a child to an ordering couple and establishment of legal parenthood including impact on the status of a child and its basic human rights etc. Based on the analysis of the above defined ethical and legal aspects, adequacy of applicable Czech legislation is then assessed with regards to specifics of the surrogate motherhood, or, eventually, amendments de lege ferenda which could bring a higher level of legal protection are proposed.
