Duplicate Record of Property Right in Land Register

Abstract:

Tématem práce je duplicitní zápis vlastnictví tzv. duplicita v katastru nemovitostí. Její vznik si vynutila praxe, která tak reagovala na přerušení kontinuity evidování vlastnických práv k nemovitostem podle přesných a přísných pravidel. Zákonná právní úprava duplicity chybí. Katastrální úřady při jejím zápisu a také při odstranění postupují podle prováděcích a interních předpisů. V práci jsou uvedeny příčiny vzniku duplicit, jejich zápis do katastrálních operátů, možnosti, které mají duplicitně evidovaní vlastníci k vyřešení tohoto nežádoucího stavu a také odstranění duplicit z katastru. Citována je judikatura Ústavního soudu, Nejvyššího soudu a Nejvyššího správního soudu. Popsán je vztah duplicity a opravy chyby v katastru nemovitostí, vztah k pozemkovým úpravám a k rozhodnutím pozemkových úřadů. Práce obsahuje doporučení Veřejného ochránce práv a kontrolních orgánů. V závěru jsou citovány příklady odstranění duplicit z katastrální praxe.

Abstract:

The topic of this thesis are duplicate entries in the real estate property. The creation of duplicates has been forced by common practice. It is a response to the discontinuity of registration of the property right under strict and precise rules. Statutory legislation concerning duplicates is missing. Land-registry offices conduct registration and removal of duplication in accordance with their implemented internal regulation. This thesis presents the causes of duplication, their registration in landregistry office, choices the duplicitly registered owners have and the removal of duplicities from the land-registry database. The jurisprudence of the Constitutional Court, Supreme Court and Supreme Administrative Court are cited. It also describes the relationship of duplication and error correction in the real estate, in the landscaping, and in the Land-Office. This thesis includes a recommendation for the Ombudsman and Audit Institutions (ZKI). Finally, casses of duplication removal are described from the practice of land-registry office.
