Administrative justice in the Czech Republic

Abstract:

Diplomová práce je věnována tématu správního soudnictví v České republice. Cílem této práce je nastínit charakter správního soudnictví jakožto specifického druhu vnější kontroly veřejné správy. V první části práce je věnována pozornost globálnějším otázkám, jako jsou druhy kontrol veřejné správy, koncepty správního soudnictví v evropských prostorách či historická geneze institutu správního soudnictví v průběhu času. Druhá část práce se pak zabývá již samotným českým správním soudnictvím a jeho specifiky. Zejména jsou zde rozebrány jednotlivé druhy řízení, jež je možné vést před českými správními soudy. Závěr práce je pak věnován komparaci se zahraniční úpravou správního soudnictví, a to konkrétně se státy Slovenské republiky a Spolkové republiky Německo.

Abstract:

This diploma thesis s dedicated to the issue of administrative justice in the Czech Republic. The main aim of this work is to present the nature of administrative justice in the Czech Republic, as a specific system of external control of public administration. The first part of the thesis deals with more global topics, such as types of external control of public administration, concepts of administrative justice in European areas or the historical genesis of the institute administrative justice. The second part of the thesis is focused on the Czech administrative judiciary itself and its specifics. These are particulary individual types of proceedings that can be conducted before the Czech administrative courts. The conclusion of the thesis serves to compare the Czech administrative judiciary with the administrative judiciary of another EU countries, specifically with the states of the Slovak Republic and the Federal Republic of Germany.
