Compensation of immaterial damage in Czech Criminal Process

Abstract:

Diplomová práce pojednává o postavení poškozeného v rámci trestního řízení, a to zejména ve vztahu k uplatnění nároku na náhradu újmy způsobené trestným činem. Institut poškozeného doznal v průběhu času řady změn a obecně lze říci, že docházelo k jeho posilování jak prostřednictvím rozšiřování jeho oprávnění v rámci trestního řízení, tak i výčtu nároků, které měl možnost uplatňovat. Poslední velkou změnu a zároveň posílení postavení poškozeného představuje novela č. 181/2011 Sb. Díky této novele má poškozený možnost vznést v rámci trestního řízení nárok na náhradu nejen škody majetkové a újmy na zdraví, ale rovněž může požadovat náhradu nemajetkové újmy a bezdůvodného obohacení pachatele trestného činu. Velkým problémem současné právní praxe je však fakt, že soudy v trestním řízení nezaujaly ve vztahu k určování výše nemajetkové újmy jednotný přístup. Ve své práci se proto budu zabývat rovněž stanovením určitých kritérií, podle nichž by bylo možné náhradu za nemajetkovou újmu vyčíslovat a zamyslím se nad dalšími možnostmi posílení postavení poškozeného nejen ve vztahu k náhradě nemajetkové újmy.

Abstract:

The presented thesis addressed the status of injured person in Czech criminal procedure, particularly in relation to the claim compensation for damage caused by the crime. The status of injured person went through many changes over time. In general, we can say, that there was a strengthening both through the expansion of its authority in the criminal procedure, as well as list of claims, which had the opportunity to apply. The last big change, which strengthen the position of the victim, is the amendment no. 181/2011 Coll. With this amendment, injured person has the opportunity to claim not only material or financial damage and damage to the health, but also may require non-pecuniary damages and unjust enrichment of offender. A major problem in contemporary legal practice is the fact, that the criminal courts have failed to take the same standpoint to determine the amount of non-pecuniary damage. In my thesis, I shall therefore also address the determination of certain criteria which could enumerate the non-pecuniary damage and even think of more possibilities for strengthening the position of the injured person not only in relation for the non-pecuniary damage.
