Penal Regulation of Stalking in the connection an § 354 Criminal Code

Abstract:

Bakalářská práce se zabývá trestným činem nebezpečného pronásledování podle § 354 trestního zákoníku, tedy jevem, který je celosvětově znám pod pojmem stalking. Cílem práce je definovat pojem stalking, popsat legislativní proces zakotvení trestného činu nebezpečného pronásledování do českého právního řádu, a dále pak podrobně analyzovat právní úpravu trestného činu nebezpečného pronásledování. Práce popisuje činnost orgánů činných v trestním řízení při prověřování stalkingu, ale rovněž i to, s čím se můžou při prověřování setkat procesní strany, tedy jakými prostředky nejen trestního, ale i správního a občanského práva bude zasahováno do jejich práv a svobod. Čtenář bude rovněž v rámci práce okrajově seznámen se slovenskou a německou trestněprávní úpravou tohoto trestného činu.

Abstract:

This bachelor’s thesis deals with a crime of stalking according to § 354 of the criminal code. The goal of the thesis is to define the term stalking, to describe the legislative process of the embodiment of the criminal act of stalking to the Czech legal code and to give a detailed analysis of the legislation of this crime. This thesis describes the activity of the law enforcement authorities during the verification of stalking. It includes furthermore what the procedural parties can encounter during the stalking verification, this means what resources of the criminal, administration and civil law will be used to interfere in their rights and liberties. The reader is within the thesis marginally introduced to the Slovak and German penal regulation of this criminal act.
