Distraint by sale of property

Abstract:

Předložená rigorózní práce se převážně zabývá dražbou nemovitostí prováděnou soudním exekutorem v exekučním řízení. Úvodem autorka definuje exekuci prodejem nemovitosti jako jeden z nejnáročnějších způsobů provedení exekuce. Dále uvádí, že k tomuto způsobu provedení exekuce soudní exekutor přistoupí zpravidla tehdy, jestliže selhaly ostatní způsoby, které může soudní exekutor dle ustanovení § 59 odst. 1 exekučního řádu využít k tomu, aby byla uspokojena pohledávka oprávněného, náklady oprávněného a náklady exekuce. Rigorózní práce shrnuje možnosti obrany třetích osob včetně manžela povinného v exe­kučním řízení. Srovnává aktuální právní úpravu s obdobím před přijetím novely občanského soudního řádu a exekučního řádu v podobě zákona č. 139/2015 Sb. Zaměřuje se především na vylučovací žalobu a institut návrhu na zastavení exeku­ce a zamýšlí se nad tím, zda zavedením ustanovení § 262b odst. 1 OSŘ došlo k na­prostému vyloučení použití vylučovací žaloby ve vztahu k manželu povinného. V práci je popsán postup pro případ, že soudní exekutor rozhodne, že exekuce bude provedena prodejem nemovitosti. Autorka se dále zabývá splněním podmínek pro provedení dražby. V práci je kladen důraz na jednotlivé fáze exekuce prováděné prodejem nemovitosti a to konkrétně ocenění nemovitosti, dražba nemovitosti a rozvrhové jednání se zaměřením na úkony soudního exekutora v jednotlivých fázích.

Abstract:

The submitted thesis primarily addresses the auction of property performed by a court distrainer in a distraint proceedings. In the introduction, the author defines distraint by sale of property as one of the most complicated methods of distraint. She also states that the court distrainer usually resorts to this method only if other methods available to the court distrainer pursuant to Section 59(1) of the Code of Distraint Procedure in order to meet the amount owed by the debtor as well as the debtor?s costs and the costs of the distraint have failed. The thesis summarizes the remedial measures of third persons including the deb­tor?s husband in the course of the law enforcement proceedings. It compares cu­rrent legislation and a period before the amendment of the Civil Procedure and the Code of Execution done by the Act No. 139/2015 Coll. The text is focused mainly on the legal action to exclude a certain thing from execution and on the motion to discontinue an execution. Authors contemplate whether the implementation of the § 262 par. 1 of the Civil Procedure eliminated the possible use of action to exclude something from execution in relation to the debtor?s husband. The thesis describes the procedure to be taken if the court distrainer decides to perform the distraint by sale of property. The author then addresses fulfilling the conditions for carrying out the auction. The thesis places emphasis on the individual phases of distraint by sale of property, specifically appraisal of the property, auction of the property and proceedings regarding distribution of the proceeds, focusing on the actions of the court distrainer in the individual phases.
