Tax and contribution burden of income tax payers in the Czech Republic

Abstract:

Cílem bakalářské práce je specifikace daňového a odvodového zatížení poplatníků u různých právních forem podnikání v ČR. Výběr vhodné právní formy se zakladá na analýze zdanění s ohledem na daňovou optimalizaci. V teoretické části práce nejprve vysvětlím základní pojmenování týkající se podnikání v České republice a definuji právní formy podnikání. Poté bude navazovat rozbor současného daňového systému ČR se zaměřením na daň z příjmů fyzických i právnických osob a na její optimalizaci. Závěrečná část literární rešerše bude zaměřena na odvodový systém pojistného v ČR. V počátku aplikační části bude představen živnostník, kterého budu v této práci analyzovat. Poté provedu různé možnosti výpočtů daně z příjmů fyzických osob a pojistého plnění s ohledem na daňovou a odvodovou optimalizaci. V propočtech zohledním odlišné varianty uplatnění výdajů paušálem či skutečně vynaloženými výdaji, u kterých budou využity odčitatelné položky a slevy na dani. V další části použiji upravená účetní data živnostníka a provedu z nich výpočet daně z příjmů právnických osob a odvodů sociálního a zdravotního pojištění. Zaměřím se na varianty s ohledem na výplatu podílů ze zisku společníkovi a zaměstnaného společníka ve společnosti s ručením omezeným. V závěrečné části předložím souhrn zjištěných výpočtů, srovnání možností daňového a odvodového zatížení a výběr optimální právní formy podnikání pro daného živnostníka.

Abstract:

The aim of this bachalor thesis is a specification of tax and levy burden for taxpayers in a variety of legal structures of business in the Czech Republic. The choice of the appropriate legal structure is based on the analysis of taxation with regard to the tax optimisation. This thesis consists of a theoretical and an application part. At the begining of the theoretical part I will explain key terms relating to business and enterpreneurship in the Czech Republic and define a variety of legal structures of business. This will be followed by an analysis of the current tax system of the Czech Republic with a focus on income tax of natural and legal persons and on its optimization. The final part of the literature research will be focused on the system of national insurance contribution payments in the Czech Republic. In the beginning of the application part I will be introduce a sole trader, whose situation I will analyze in this thesis. I will perform a variety of calculations of the income tax and national insurance contributions of natural persons with regard to tax and levy optimization. In these calculations I will take into consideration different variants of expenditure applying lump fee or actually incurred expenditure, for which I will use deductible items and tax credit. In the next section, I will use the adjusted accounting data of the sole trader and I will use them to calculate corporate income tax and contributions to social and health insurance. In these calculations I will focus on an option that considers payment of shares of profits to an associate and an option of an associate employed by a company with limited liability. In the conclusion I will present a summary of performed calculations as well as a comparison of the possibble tax and levy burdens and a choice of the optimum legal business structure for the trader.
