Impact of the amendment to Act No. 395/2009 Coll. on supplier-customer relations in the Czech Republic

Abstract:

Diplomová práce „Dopady novelizace zákona č. 395/2009 Sb. na dodavatelko-odběratelské vztahy vČeské republice“ přináší důkladnou analýzu vlivu změn v legislativě na obchodní prostředí a nepřímo navazuje na mou bakalářskou práci. Přináší hlubší pochopení problematiky, zejména dopadů novelizace uvedeného zákona na vztahy mezi dodavateli a odběrateli. Pro dosažení cílů práce byla použita kombinace kompilativní a analytické metody. Kapitoly se zaměřují na vymezení základních pojmů, analýzu významné tržní síly a obratových pásem, problematiku zneužití významné tržní síly, kontrolní orgány, sektorové šetření, implementaci směrnice Evropské unie a Rady Evropy, krátkého exkurzu na Slovensko v porovnání této právní normy a základních procesních institutů při šetření nekalých obchodních praktik. Závěr práce nalézá odpověď na výzkumnou otázku: „Přispěla poslední novelizace tohoto zákona o významné tržní síle k narovnání vztahů mezi dodavateli a odběrateli v České republice?“.

Abstract:

The diploma thesis "Impact of the amendment to Act No. 395/2009 Coll. on supplier-customer relations in the Czech Republic" brings a thorough analysis of the impact of changes in legislation on the business environment and indirectly follows my bachelor thesis. It brings a deeper understanding of the issues, especially the impact of the amendment on supplier-customer relations. A combination of compilation and analytical methods was used to achieve the objectives of the thesis. The individual chapters focus on the definition of basic concepts, analysis of significant market power and turnover bands, the issue of abuse of significant market power, controlling authorities, sectoral investigations, implementation of the EU and Council of Europe Directive, a short excursion to Slovakia in the comparison of this legal norm and basic procedural institutes in the investigation of unfair commercial practices. The thesis concludes by answering the research question: „Has the last amendment of this law on significant market power contributed to the settlement of relations between suppliers and customers in the Czech Republic?“.
