Rights and obligations of forest owners and visitors and their liability for damage

Abstract:

Práce popisuje zákonnou úpravu práv a povinností včetně právní odpovědnosti subjektů využívající produkční a mimo produkční funkce lesa. V textu jsou také popsány instituty řešící ochranu lesa, kromě nich se práce věnuje i omezení vlastnického práva vlastníků lesa vlivem § 19 odst. 1 zákona o lesích, který zakotvuje tzv. veřejné užívání lesů. Samotná odpovědnost je v práci zkoumána ze dvou rovin. Tou první je správněprávní odpovědnost v rámci využívání produkčních funkcí lesa, zabývá se tedy porušením lesního zákona v rámci využívání těchto funkcí. Druhou rovinou je odpovědnost vlastníka lesa vůči návštěvníkům a s tím spojená tzv. prevenční povinnost jež je také zakotvena v § 22 zákona o lesích. Diplomová práce se také zabývá právy a povinnostmi návštěvníků lesa a jejich odpovědností za škody při poškození lesa nebo využívání mimoprodukční funkcí lesa. Práce snaží poukázat na určité slabiny zákonné úpravy. Výklad zákonné úpravy je upřesňován judikaturou českých soudů. Pro obohacení je práce doplněna o dotazníkové šetření, které se věnuje znalostí lesního zákon mezi veřejností (návštěvníky lesů).

Abstract:

This thesis describes the legislative regulation of the rights and obligations including legislative responsibility of the subjects that utilise production and non-production services of the forest. In this text, the institutions dealing with forest protection are also described, besides this, the thesis deals also with regulation of the ownership rights of forest owners due to section 19, paragraph 1 of the Act on Forests, which establishes the so-called public use of forests. Responsibility itself is in this thesis examined from two levels. The first examined level is the legally administrative responsibility in relation to the use of production services of forests, therefore it deals with violations of the Act on Forests within the utilisation of these services. The second level is the responsibility of the forest owner towards its visitors and related so-called preventive duty, which is also established in section 22 of the Act on Forests. The Diploma thesis also deals with the rights and responsibilities of the visitors of the forest and their liability for damages caused to forests or utilisation of non-production services of forests. This work aims to showcase certain weaknesses of the legislative regulation. Interpretation of the legislative regulation is specified by the case law of Czech courts. The thesis is enriched by a survey which is dedicated to find out the knowledge of the public (visitors of forests) of the Act on Forest.
