Special ways of proving – history, present, considerations de lege ferenda

Abstract:

Téma mé diplomové práce je „Zvláštní způsoby dokazování – historie, současnost, úvahy de lege ferenda. V první části práce se zabývám dokazováním obecně a dokazováním z pohledu historie. V další části se zabývám některými zvláštními způsoby dokazování stanovených trestních řádem z pohledu kriminalistického a z pohledu trestního práva. Cílem diplomové práce je za použití poznatků získaných studiem kriminalistické literatury shrnout poznatky o některých zvláštních způsobech dokazovaní jako o kriminalistických úkonech a důkazních prostředcích. V závěru každé kapitoly se práce zabývá vadami, které vznikají nebo mohou vznikat při provádění některého ze zvláštních způsobů dokazování, návrhy na jejich řešení a úvahami de lege ferenda. U rekognice a prověrky na místě je analyzován a zhodnocen konkrétní případ.

Abstract:

The topic of my thesis is the „Special ways of proving – history, present, considerations de lege ferenda“. I am focusing on the proving from a generally perspective and from a perspective of history in the first part of thesis. I am focusing on the some special ways of proving defined by the criminal law from criminalistic point of view and from a perspective of a criminal law. The goal of my thesis is to summarize the knowledge about some special ways of proving like criminal acts and like a proofs by criminalistic literature. I am focusing on the imperfections of some special ways of proving, which arise or may arise during special ways of proving, by suggesting solutions of imperfections at the end of this thesis. I am analysing and rating concrete case at an identity parade and at a check on place.
