Damage to the financial interests of the European Communities

Abstract:

Bachelor's thesis deals with the damage the financial interests of the European Communities. The legal basis for protecting the financial interests of the Convention on the protection of financial interests, according to the criminal law in all countries is needed to ensure the criminal act of fraud against the Communities' financial interests. In Article 3. 4 of the Act of Accession of the Slovak Republic undertook to accede to international treaties on justice and home affairs, which at the date of accession open for signature by the present Member States, as well as international agreements which were drawn up by the Council in accordance with Title VI. Treaty on European Union, and whose adoption was recommended by the Member States. Such international agreements within the scope of the Ministry of Justice include the Convention on the protection of financial interests, which was fully implemented into Slovak law. Law no. 421/2002 Z.z. were in the Penal Code introduced new elements of criminal acts harming the financial interests of the European Communities. Also in our legal system has been implemented and the provisions of the Second Protocol to the Convention.

Abstract:

Bakalárska práca sa zaoberá poškodzovaním finančných záujmov Európskych spoločenstiev. Právnym základom ochrany finančných záujmov je Dohovor o ochrane finančných záujmov Spoločenstva, podľa ktorého v trestnom práve všetkých štátov Spoločenstva je potrebné zabezpečiť ustanovenie trestného činu podvodu proti finančným záujmom Spoločenstva. V článku 3 ods. 4 Aktu o podmienkach pristúpenia sa Slovenská republika zaviazala pristúpiť k medzinárodným zmluvám z oblasti spravodlivosti a vnútra, ktoré sú ku dňu pristúpenia otvorené na podpis pre súčasné členské štáty, ako aj k medzinárodným zmluvám, ktoré boli vypracované Radou v súlade s hlavou VI. Zmluvy o Európskej únii a ktorých prijatie bolo odporučené členským štátom. K takýmto medzinárodným zmluvám v oblasti pôsobnosti Ministerstva spravodlivosti SR patrí aj Dohovor o ochrane finančných záujmov Spoločenstva, ktorý bol plne implementovaný do právneho poriadku Slovenskej republiky. Zákonom č. 421/2002 Z.z. boli do Trestného zákona zavedené nové skutkové podstaty trestných činov poškodzovania finančných záujmov Európskych spoločenstiev. Taktiež do nášho právneho poriadku boli implementované aj ustanovenia Druhého protokolu k tomuto dohovoru.
