The Claims Emerging at the End of a Service Relationship

Abstract:

Disertační práce se zabývá peněžitými nároky ze služebního poměru, které vznikají příslušníkům bezpečnostních sborů v souvislosti se skončením jejich služebního poměru. Jedním ze způsobů skončení služebního poměru je i úmrtí příslušníka. Práce se proto zaměřuje i na nároky pozůstalých a dalších osob spojených s úmrtím příslušníka. Za tím účelem práce opouští tradiční dělení (zejm. na výsluhové a odškodňovací nároky) a navrhuje nové, z pohledu služebních funkcionářů praktičtější členění. Základním kritériem je osoba oprávněného: zda jí je sám (bývalý) příslušník, nebo pozůstalí. Jelikož nároky ze služebního poměru nejsou jedinými, které mohou oprávněným při skončení služebního poměru vzniknout, zkoumá práce vazby těchto nároků k plněním z ostatních systémů (zejm. sociálního zabezpečení). Při jejich výskytu se následně řeší konkurence k nárokům ze služebního poměru, zda lze všechny nároky pobírat ve vzájemném souběhu, nebo dochází ke kolizi, která vede ke zkrácení některého z plnění. K vedlejším výzkumným otázkám řešeným disertační studií náležejí jak ty, které jsou již v teorii relativně často diskutované (např. povaha služebního poměru), ale i ty, jimž se doposud literatura ani kvalifikační práce nevěnovaly (zejm. nezpracované poznatky veřejného ochránce práv k oblasti služebního poměru příslušníků bezpečnostních sborů).

Abstract:

The Ph.D. thesis deals with the monetary entitlements emerging from the service relationship of members of the security forces at the end of their service relationship. One of the ways of termination of service is the death of a member. Therefore, the thesis also focuses on the entitlements of the bereaving persons and other persons' entitlements emerging with the member's death. The thesis abandons the traditional division (in particular into retirement claims and damages) and sets forth a new, more practical division from the point of view of service officials. The elementary criterion is the person entitled: whether it is the (former) serviceman himself or his bereaving persons. As service entitlements are not the only entitlements that may arise for beneficiaries on termination of service, the thesis aims at the links between these entitlements and benefits from other schemes (in particular social security). Where these arise, their relationship to service entitlements is then addressed, whether all entitlements can be received at their full scale or whether a conflict leads to a reduction in one of the benefits. The supportive research questions examined by the Ph.D. thesis include those that are already relatively frequently discussed in theory (e.g., the legal nature of the service relationship), but also those that have not been addressed in the literature or other thesis (in particular, the reports of the Czech Public Defender of Rights on the service relationship of members of the security forces).
