New Precedents for Generally Binding Public Ordinances

Abstract:

Ústavní limity pro vydávání obecně závazných vyhlášek obcí v jejich samostatné působnosti jsou určeny článkem 104 odst. 3 Ústavy ČR. Rozvedením tohoto článku, ve smyslu stanovení věcné působnosti obcí vydávat obecně závazné vyhlášky, je potom ustanovení § 35 odst. 3 písm. a) zákona o obcích. Podle tohoto ustanovení se obec, při výkonu samostatné působnosti při vydávání obecně závazných vyhlášek, řídí zákonem. Tomuto zákonnému příkazu odpovídá vymezení věcných oblastí, v nichž je obec oprávněna bez zákonného zmocnění tvořit právo (§ 10 zákona o obcích). Z toho lze dovodit, že obec je při vydávání obecně závazných vyhlášek limitována jen mezemi své působnosti vymezené zákonem a nemůže upravovat otázky, které jsou vyhrazeny pouze zákonné úpravě. Je-li obec oprávněna, na základě čl. 104 odst. 3 Ústavy, vydávat obecně závazné vyhlášky a tvořit tak právo v zákonem vymezených věcných oblastech, nepotřebuje k uložení konkrétních povinností, vedle § 10 zákona o obcích, pro oblasti tam uvedené, ještě další výslovné zákonné zmocnění. Dle čl. 101 odst. 4 Ústavy stát může zasahovat do činnosti územních samosprávných celků, jen vyžaduje-li to ochrana zákona, a jen způsobem stanoveným zákonem. V případě obecně závazných vyhlášek se jedná o dozor, prováděný Ministerstvem vnitra, při kterém stát následně zjišťuje, zda územní samosprávné celky při výkonu své samostatné působnosti respektují zákony. Dozor se zaměřuje až na následek a nemá preventivní charakter. Dozorová opatření lze uplatnit pouze v případě zjištěné nezákonnosti, přičemž je potřeba řídit se ústavními principy zajišťujícími právo na územní samosprávu. Dozorové činnosti je věnována první část bakalářské práce. Druhá část práce je věnována postupu dozorového orgánu při nezjednání nápravy a následné rozhodování Ústavního soudu ve věci návrhu na zrušení obecně závazné vyhlášky včetně uvedení posledních nálezů vydaných Ústavním soudem. V případě nezjednání nápravy obecně závazné vyhlášky předkládá Ministerstvo vnitra návrh na její zrušení Ústavnímu soudu, neboť jemu je svěřeno posuzování zákonnosti a ústavnosti právních předpisů územní samosprávy. Jedním druhem rozhodnutí Ústavního soudu je nález, rozhoduje se jím ve věci samé. Vydáním nálezu ÚS není primárně sledováno vyřešení konkrétního případu na úrovni jednoduchého práva a skutkových zjištění; účelem je závěr nejvyššího, na otázky ústavnosti specializovaného arbitra ve státě, do jaké míry je určitý právní předpis nebo individuální právní akt ve shodě či v nesouladu s předpisy nejvyšší právní síly a s jejich hodnotovými kategoriemi, přesahujícími oblasti pouhé formálně pojímané právní státnosti a utilitární tvorby práva. Věřím, že se mi podařilo srozumitelně – leč vzhledem k rozsahu zadání bakalářské práce stručně – přiblížit problematiku obecní právotvorby a upozornit na některá úskalí vyplývající z nálezů Ústavního soudu.

Abstract:

Constitutional limits in the process of issuance of generally binding ordinances of municipalities within their independent jurisdiction are defined by Article 104 Para 3 of the Constitution of the Czech Republic. This article is further specified by the provisions of Sec. 35 Para 3 Letter a) of the Act on Municipalities that deals with the definition of the substantively defined area in which municipalities can pass generally binding ordinances. This provision stipulates that municipality acting within the scope of its independent jurisdiction in the issuance of generally binding ordinances shall comply with the law. This lawful order corresponds to the provision of substantively defined areas in which municipality may lay down law without legal authority (Sec. 10 of the Act on Municipalities). That said, we can assume that in the process of issuance of generally binding ordinances a municipality shall be limited only by its jurisdiction defined by the law and it can not regulate matters that are reserved to legal regulation only. If a municipality is entitled to pass its generally binding ordinances, in line with the provisions of Article 104 Para 3 of the Constitution of the Czech Republic, i.e. to lay down law within substantively defined areas defined by law, it does not need any other explicit statutory powers in order to be able to lay a specific obligation, aside from the provisions of Sec. 10 of the Act on Municipalities, for areas mentioned therein. Pursuant to Article 101 Para 4 of the Constitution of the Czech Republic the state may intervene in the activities of self-governing territorial divisions only if such intervention is required by protection of the law and only in a manner defined by law. In case of generally binding ordinances this intervention is represented by oversight by the Ministry of the Interior, in the course of which the state makes sure that self-governing territorial divisions comply with laws in the process of execution of their jurisdiction. This oversight shall be focused on results and it shall not be of preventive nature. Oversight measures can be implemented in case of maladministration only; whereas it is necessary to make sure that constitutional principles are not violated with respect to the right to territorial self-governing. The oversight activities shall be the object of interest of the first part of this bachelor’s thesis. The second part of the thesis focuses on the steps taken by a supervisory body in case remedy is not provided for and on the subsequent ruling of the Constitutional Court in the matter of a petition for the annulment of a generally binding ordinance, including the listing of the most recent Constitutional Court judgments. In case remedy of a generally binding ordinance is not provided for the Ministry of the Interior shall submit a petition before the Constitutional Court to annul the ordinance, as the Constitutional Court, since it is the court’s power to assess legitimacy and constitutionality of statutory regulations passed by territorial self-government. One form of decisions of the Constitutional Court is judgment, which is a decision in a particular matter as such. When delivering judgment the Constitutional Court does not seek resolution of the case at hand on the level of simple law and res gestae; its purpose is to obtain a resolution of the highest arbiter in the country who decides on the matters of constitutionality, as to which extent a certain statutory regulation or individual legal act is in compliance or in conflict with regulations of the highest legal force and their value categories that exceed the limits of simple formal understanding of legal statehood and utilitarian approach towards the crafting of laws.
