Abstract:

Bakalářská práce je zaměřena na velice aktuální téma držení a nošení zbraně a střeliva. Jejím základním cílem je kvalitativní analýza možných nástrojů/prostředků zákona o střelných zbraní a střelivu ČR vedoucích ke zvyšování obranyschopnosti jednotlivce i státu, a v případě zjištění nedostatků navrhnout jejich řešení. Nejprve jsou vymezeny důležité pojmy, uveden je také obsahu zákona č. 119/2002 Sb., který klasifikuje zbraně a střelivo, stanovuje skupiny zbrojního průkazu i podmínky nabývání, držení a nošení zbraní a střeliva. Poté je analyzován příspěvek tohoto zákona k zajištění bezpečnosti a obranyschopnosti jednotlivce i státu. Následně se práce zaměřuje na praktickou část, tedy výzkumné šetření pomocí dotazníku. Šestá kapitola této práce komplexně hodnotí účinnost zákona č. 119/2002 Sb. z teoretického i praktického hlediska. Poté jsou formulovány náměty de lege ferenda. Jak bylo zjištěno, otázka nabývání, držení i nošení zbraní a střeliva je v současnosti velmi aktuální. Velmi důležité je zakotvení institutů nutné obrany a krajní nouze do platného zákona. V rovině společnosti jako celku je navíc možné využít schopností a dovedností ozbrojených civilistů pro účely stanovených záloh státu, držitelé zbrojních průkazů nezřídka zasahují i při náhlých situacích spojených s ohrožením života a zdraví dalších osob. Platný zákon č. 119/2002 Sb. tedy všestranně přispívá zvyšování bezpečnosti a obranyschopnosti občana i státu.

Abstract:

The bachelor's thesis is focused on the very current topic of possession and carrying of weapons and ammunition. Its basic goal is a qualitative analysis of possible tools/means of the Law on Firearms and Ammunition of the Czech Republic leading to an increase in the defense capability of the individual and the state, and in case of deficiencies, to propose their solutions. First, important concepts are defined, and the content of Act No. 119/2002 Coll., which classifies weapons and ammunition, sets the groups of firearms licenses and the conditions for acquiring, possessing and carrying weapons and ammunition, is also given. The contribution of this law to ensuring the security and defense of the individual and the state is then analysed. Subsequently, the work will focus on the practical part, i.e. a research investigation using a questionnaire. Chapter six of this work comprehensively evaluates the effectiveness of Act No. 119/2002 Coll. from a theoretical and practical point of view. Then the topics de lege ferenda are formulated. As has been established, the issue of acquiring, possessing and carrying weapons and ammunition is currently very topical. It is very important to enshrine the institutes of necessary defense and extreme emergency in the applicable law. In addition, at the level of society as a whole, it is possible to use the abilities and skills of armed civilians for the purposes of the state reserves, holders of firearms licenses often intervene in sudden situations involving threats to the life and health of other persons. Valid Act No. 119/2002 Coll. therefore, it makes a comprehensive contribution to increasing the security and defense capability of the citizen and the state.
