Abstract:

Hlavním předmětem této bakalářské práce je právní a finanční rozbor odpovědnosti zaměstnavatele za škodu, podle zákona 262/2006 Sb., a to ve vybrané zemědělské společnosti. Budu se zabývat odškodněním pracovního úrazu. Jak již bylo zmíněno hlavním cílem této práce je vytvořit jednotný a přesný přehled této problematiky. V teoretické části budou rozebírány a vysvětlovány jednotlivé zákony, které se této problematiky budou týkat a to především odpovědnosti zaměstnavatele za škodu, ochranu zdraví při výkonu práce a samozřejmě i pojištění odpovědnosti. Především se budu více zaměřovat na pracovní úrazy, které se v dnešní době čím dál více vyskytují. Praktická část se bude zabývat především praktickými pracovními úrazy a jejich evidencí a způsobu odškodnění ve vybraném zemědělském podniku, tento podnik se zabývá chovem prasat, skotu, ale také pěstováním obilnin a máku. Tento text se bude především zaměřovat na hlášené pojistné události, náhrady bolestného a také ztráty z výdělku. Dalším krokem bude provedena analýza jednotlivých úrazu a následné odůvodnění pojistného v období fungování firmy. Součástí práce bude samozřejmě dotazníkové pátrání, které bude provedeno mezi zaměstnanci. Na závěr budou uvedeny výsledky dotazníkového šetření, výsledky z jednotlivých konkrétních případů a s tím spojeny i návrhy opatření ke zmírnění následků nehod, nebo úplné odstranění těchto nehod.

Abstract:

The main topic of this thesis is primarily legal and financial analysis of employer´s responsibility for injuries according to the law 262/2006 Sb. in a chosen agricultural company. The attention is particularly paid to compensations for industrial injuries. As mentioned, the aim of this thesis was to create a united and exact overview of this issue. In the theoretical part the laws connected with the given topic are mentioned and explained, especially the laws which are devoted to employer´s responsibility for harm and injury, health and safety system in the practice of a profession and liability insurance. One part deals with industrial injuries which nowadays occur very often. The practical part deals with real industrial injuries, their registration and method of their compensations in the chosen agricultural company, which engages in breeding pigs, beef cattle, growing cereals and poppy. This part contains reported insured accidents, compensations for the injuries and losses of earnings as well as the analysis of particular injuries and justification of insurance premium in the company. The survey, which has been done among the employees of the company, makes the next part. The conclusion of this thesis includes both the results of the mentioned survey and the results of particular introduced cases. On the basis of the findings facts some proposals of safety measures have been developed to lower consequences of accidents and to remove their causes in the future.
