Abstract:

Diplomová práce se soustředí na problematiku nemovitých věcí užívaných při podnikatelské činnosti v kontextu české právní úpravy. Samotným cílem práce je zmapovat důležité účetní a daňové aspekty, které jsou s vlastnictvím či pronájmem nemovitosti spojeny. Kromě vymezení stěžejních právních předpisů je kladen důraz na popis specifik při pořízení, provozu a následném vyřazení nemovitosti. Pozornost je taktéž věnována jednotlivým typům daní, jež jsou s nemovitými věcmi spojeny. Teoretická část práce je pravidelně prokládána praktickými příklady, které se blíže věnují vybraným účetním a daňovým problémům s tím, že účetní řešení těchto příkladů je znázorněno za pomoci výstřižků z účetního softwaru. V nejasných oblastech autor kromě platných právních předpisů uplatňuje i doporučení a názory odborné veřejnosti včetně příslušné judikatury.

Abstract:

The diploma thesis focuses on the issue of immovable property used in business activities in the context of Czech legislation. The very goal of the thesis is to map the important accounting and tax aspects that are connected with the ownership or rental of real estate. In addition to the definition of key legal regulations, emphasis is placed on the description of the specifics of the acquisition, operation and subsequent disposal of real estate. Attention is also paid to individual types of taxes associated with real estate. The theoretical part of the thesis is regularly interspersed with practical examples that focus more closely on selected accounting and tax problems, with the accounting solution of these examples being illustrated with the help of clippings from accounting software. In unclear areas, in addition to valid legal regulations, the author also applies recommendations and opinions of the professional public, including relevant jurisprudence.
