Contract for Construction Work from the Perspective of the Contractor

Abstract:

Předmětem diplomové práce je smlouva o dílo ve výstavbě z pohledu zhotovitele. Cílem práce bude předložit vlastní návrh na zlepšení smlouvy o dílo z pohledu zhtovitele.V teoretické části jsou zmíněny poznatky o historickém vývoji smlouvy o dílo od starověkého Řecka a Říma až po současnost, dále základní charakteristika smlouvy o dílo, její podstatné a nepodstatné prvky, specifika smlouvy o dílo ve výstavbě a náhled na smlouvu o dílo v SRN. V praktické části jsme provedli analýzu smlouvy o dílo z pohledu objednatele a z pohledu zhotovtiele. V návrhové části představujeme náš návrh na zlepšení smlouvy o dílo na základě chyb a nedostatků odhalených v analýze

Abstract:

The subject of the thesis is contract for construction work from the perspective of the contractor. The goal is to introduce our own proposal on how to improve the contract for construction work from the perspective of the contractor. In the theoretical-methodological part we make the reader familiar with the historical development of the contract for work from antique Greece and Rome to present. Then we continue with the main characteristics of the contract for work in genereal, its essential and non-essential parts, specifics of the contract for construction work and the contract for construction work in Germany. In the analytical-practical part we analyzed particular contracts for construction work from the perpesctive of the contractor and from the perspective of the client. The analytical section is focused on our proposal on how to improve the contract for construction work from the perspective of the contractor based on the issues and mistakes that we have discovered thanks to our analysis.
