Supervision and control of the implementation of public procurement in the Czech Republic

Abstract:

Veřejné zakázky jsou v dnešní době velmi diskutovanou oblastí. Jedná se o úplatné poskytnutí určitého statku či služby a tato úplata je poskytována z veřejných financí. Právě z důvodu manipulace s těmito financemi je zde vysoká míra kontroly a dohledu ze strany orgánů státní správy ČR. Nejedná se jen o orgány na vnitrostátní úrovni, ale i o orgány na úrovni komunitární, které svými pravomocemi mohou ovlivňovat průběh realizace veřejných zakázek na našem území. Mimo evropské regulace ve formě směrnic, nařízení aj. dokumentace, vystupuje Evropská unie i jako poskytovatel dotací, mimo jiné, na realizaci veřejných zakázek. Diplomová práce vytváří souhrnný přehled o těchto orgánech a jejich kompetencích v oblasti dohledu a kontroly veřejných zakázek. Zadavatel, při zadávání veřejné zakázky, může pochybit a v takovém případě vstupují do průběhu realizace veřejné zakázky orgány, které kontrolují správnost postupu zadavatele. Praktická část je pak založena na příkladu z praxe, kde se setkáváme právě s oním pochybením ze strany zadavatele a vstupem kontrolních orgánů do realizace. Jelikož byla na tuto veřejnou zakázku čerpána dotace, komplikuje se tak vztah hierarchie rozhodnutí dohledových orgánů. Praktická ukázka tedy uvádí vztahy mezi jednotlivými orgány při jejich rozhodování v rámci kontroly. Co se tedy stane, když kontrolní orgán zamítne proplacení nákladů z důvodu pochybení při realizaci veřejné zakázky? Na koho se zadavatel obrátí? Tyto otázky zodpovídá praktická část. Diplomová práce na základě zjištěných pochybení v průběhu realizace veřejné zakázky a čerpání finanční podpory z operačního programu, vytváří jejich souhrnný přehled a následné doporučení pro zadavatele, kteří realizaci veřejné zakázky zahajují.

Abstract:

Public procurement is a much-discussed area today. It is about a paid provision of particular goods or services, that are provided from the public funds. Because of the high risk of manipulating with these funds, there is a high level of supervision done from the side of the government of the Czech Republic. This is not just on the national authority’s level, but also on the European community one, where they can with their power, influence the course of implementation of the public procurement in our territory. Except the European regulations in the form of directives, regulation and other documentation, European union also acts like a donator among others, also for implementation of public procurement. This thesis creates an overview about these authorities and their competencies in the field of supervision and control of public procurement. When the public procurement is being submitted and there is a failure in the process, in such case, the public procurement authorities enters the process and checks the correctness of the contracting authority's approach. The practical part is then based on an example from practice, where we encounter above mentioned failure from the side of the submitter and entry of the controlling authority into the realization. Since this contract was granted, the relationship of the hierarchy of supervisory authorities is much more complicated. Practical example therefore states the relationships between particular authorities in their decision-making process. So, what happens when the controlling authority refuses to reimburse costs due to a misconduct in the realization of public procurement contract? To whom the submitter can turn to? These questions are answered by the practical part. Diploma thesis creates a summary, based on the detected misconducts during the implementation of the public contract and drawing of financial support from the operational program and provides following recommendations for the submitter, who initiated the procurement.
