The role of banks in the fight against money laundering

Abstract:

Hlavním cílem této diplomové práce bylo vyhodnotit postoje českých bank v oblasti praní špinavých peněz na základě zvolených kritérií. Vedlejším cílem práce bylo ověřit předpoklad, že opatření proti praní peněz jsou v České republice harmonizována s opatřeními na úrovni EU. První část práce se zabývá obecným vymezením problematiky praní špinavých peněz, včetně využívaných metod praní peněz a historického kontextu tohoto jevu. V další části práce je vymezeno institucionální prostředí v rámci této oblasti. Následující část se zabývá analýzou právních dokumentů na úrovni EU a na úrovni České republiky. Na základě analýzy dokumentů lze usoudit, že právní úprava ČR je harmonizována na úrovni právních dokumentů EU s tím, že legislativa ČR poskytuje v určitých oblastech přísnější opatření, než jaká jsou uložena EU. Následující část byla věnována zhodnocení postojů českých bank v oblasti praní špinavých peněz. Z výsledků je zřejmé, že české banky uplatňují různé pří-stupy a strategie AML v tom, jakým způsobem a v jakém rozsahu poskytují informace svým klientům a veřejnosti.

Abstract:

The main aim of this master's thesis was to evaluate the attitudes of Czech banks towards money laundering based on selected criteria. A secondary objective was to verify the assumption that anti-money laundering measures in the Czech Republic are harmonized with measures at the EU level. The first part of the thesis deals with the general definition of money laundering, including the used money laundering methods and the historical context of this phenomenon. The following section defines the institutional framework within this area. The subsequent part deals with the analysis of legal documents at the level of the EU and at the level of the Czech Republic. Based on the analysis of these documents, it can be concluded that the legal regulations in the Czech Republic are harmonized with those of the EU, with the fact that the legislation of the Czech Republic provides stricter measures in certain areas than those imposed by the EU. The following part was devoted to the evaluation of the attitudes of Czech banks in the area of money laundering. The results indicate that Czech banks employ various approaches and AML strategies in terms of how and to what extent they provide information to their clients and the public.
