Serious offender in terms of criminal law and criminology

Abstract:

Diplomová práce se zabývá tématem Pachatel trestného činu z hlediska trestního práva a kriminologie a je členěna do pěti po sobě jdoucích hlavních kapitol. Úvodní kapitola pojednává o pachateli jako o subjektu trestného činu z hlediska trestního práva. Tato kapitola obsahuje také trestní součinnost, formy účastenství a v neposlední řadě také problematiku trestní odpovědnosti právnických osob. Další část práce je zaměřena na psychologické zkoumání osobnosti pachatele, její základní dělení a ne méně důležitou vyšetřovací metodu psychologického profilování. Pojmem osobnost pachatele se práce zabývá také v další kapitole, avšak z pohledu kriminologie. Další kapitola se orientuje na profil mladistvého delikventa, příčiny vzniku delikventního chování a jeho prevenci. Závěrečná část práce je věnována komparaci spodní věkové hranice trestní odpovědnosti v České republice a vybraných zemích.

Abstract:

The dissertation explores the theme of a criminal offender in terms of criminal law and criminology and is parted into five following main chapters. The opening chapter discusses about a criminal offender as about a subject of a criminal offence in terms of criminal law. This chapter is also consisted by a theme of criminal collaboration, the forms of participation and last but not least, the problematic of criminal liability of legal persons. Next part of thesis is focused on psychological exploration of the offender´s personality, its basic division and no less investigative method of psychological profiling. Next chapter examines the concept of offender´s personality as well, however, rather from the criminological perspective. Following chapter is oriented on the profile of youthful delinquent, the causes of origin of delinquent behaviour and its prevention. The closing part of thesis compares the age of criminal responsibility in the Czech Republic and in chosen countries.
