Claims in proceeding of insolvency

Abstract:

Cílem této práce je objasnit pojem pohledávky v insolvenčním řízení, vysvětlit průběh tohoto řízení, postupy jednotlivých účastníků spojené s pohledávkami v rámci insolvenčního řízení, např. soudu, věřitele, dlužníka a insolvenčního správce. V teoretické části práce jsou charakterizovány důležité pojmy z oblasti insolvence a dále jsou rozebírány postupy soudu, insolvenčního správce, věřitelů a dlužníka v rámci celého insolvenčního řízení. Převážná část teorie je věnována pohledávkám, a to zejména z pohledu věřitele. Z důvodu obsáhlosti insolvenčního zákona je práce zaměřena na postup dlužníka a věřitele v konkursu a způsoby uspokojování pohledávek v jeho průběhu. Nedílnou součástí jsou i dopady na účetní evidence obou účastníků řízení. V aplikační části jsou metodou analýzy a popisu rozebrány přihlášky pohledávek dvou věřitelů, kteří se účastní insolvenčního řízení za dlužnou společností s ručením omezeným.

Abstract:

The aim of this work is to clarify the concept of claims in insolvency proceedings, to explain the course of proceedings, the practice of individual participants associated with claims in insolvency proceedings such as court, creditor, debtorand the insolvency administrator. In the theoretical part, important concepts of insolvency are characterized. Further, the work focuses on court procedures, a bankruptcy trustee, creditors and the debtor under the insolvency proceedings. Most of the theory is devoted to claims, particularly from the creditor’s perspective. For the comprehensiveness and length of the insolvency law, the work focuses on practices of a debtor and creditors in bankruptcy, and ways of meeting the claims in that period. Next, the impacts on the accounts evidence of the two parties are an integral part of the work. In the application part, using the method of analysis and description, registrations of two creditors‘ claims, who are involved in insolvency proceedings due to a limited liability company, are analyzed.
