International Criminal Court - Effective Permanent Judicial Institution of Universal Character?

Abstract:

Předložená diplomová práce, která nese název "Mezinárodní trestní soud - funkční stálá soudní instituce univerzálního charakteru?" se zabývá teorií a praxí mezinárodního práva trestního. V úvodní části je pojednáváno o vytváření ad hoc trestních tribunálů, jež vedlo mezinárodní společenství k názoru, že je zapotřebí vytvořit Mezinárodní trestní soud jako instituci stálého charakteru. Dále se věnuji analýze Římského statutu Mezinárodního trestního soudu jakožto otevřené mezinárodní smlouvě a zaměřuji se především na jurisdikci soudu. Ta se vztahuje na genocidu, zločiny proti lidskosti, válečné zločiny a očekává se, že se bude v budoucnu po přijetí příslušné definice vztahovat také na zločin agrese. Následně analyzuji a hodnotím argumenty kritiků a stoupenců Římského statutu a dále popisuji případy, které jsou soudem v současné době vyšetřovány v Africe. V neposlední řadě věnuji podstatnou pozornost procesu implementace statutu v České republice a možným ústavněprávním problémům. V závěru práce je zhodnocen efekt založení Mezinárodního trestního soudu a jeho přínos pro mezinárodní trestní spravedlnost.

Abstract:

This thesis with a title "International Criminal Court - Effective Permanent Judicial Institution of Universal Character?" deals with the theory and practice of international criminal law. In the first part several ad hoc tribunals are discussed that led the international community to the opinion that a creation of a permanent international criminal court is necessary. Then the Rome Statute of the International Criminal Court as an open international agreement is analyzed with the main focus on the jurisdiction of the court. That refers to genocide, crimes against humanity, war crimes and it is expected that after an acceptance of a relevant definition in the future to the crime of aggression. Sequentially I analyze and value the arguments of the critics and supporters of the Rome Statute and describe the current cases that the court investigates in Africa. Finally a significant attention is paid to the process of implementation in the Czech Republic and possible constitutional problems. At the end of the thesis the effect of the foundation of the International Criminal Court and its contribution to the international criminal justice is evaluated.
