Tax execution according to valid legislation

Abstract:

Bakalářská práce s názvem Daňová exekuce dle platné legislativy vymezuje základní pojmy jako jsou např. daň, správa a správce daně, nedoplatek a další, které jsou základem pro pochopení celého principu daňové exekuce. Práce se zaměřuje na legislativní předpisy, které daňovou exekuci upravují. Další část této práce už se zaměřuje přímo na daňovou exekuci. Vysvětluje, že daňovou exekuci lze provést pouze několika způsoby a při splnění určitých podmínek. Popisuje práva a povinnosti exekutora, jakožto osoby vykonávající exekuci. V třetí kapitole této bakalářské práce nalezneme fáze exekučního řízení včetně ochrany povinného a třetích osob a možnosti daňovou exekuci odložit, nebo zcela zastavit. Nejrozsáhlejší kapitolou této bakalářské práce je kapitola čtvrtá, která popisuje jednotlivé formy daňové exekuce. Mezi tyto formy patří daňová exekuce srážkami ze mzdy, přikázáním pohledávky z účtu u poskytovatele platebních služeb, přikázáním jiné peněžité pohledávky, postižením jiných majetkových práv a prodejem movitých věcí a nemovitostí. Více se zabývá dražbou, která je u prodeje movitých věcí a nemovitostí hlavní fází této formy exekuce. V této práci nalezneme také možnosti obrany dlužníka. Závěrem této práce jsou praktické příklady, které umožňují tuto problematiku lépe pochopit.

Abstract:

The bachelor thesis entitled Tax Execution according to valid legislation defines the basic terms such as taxes, tax administration and tax administrator, tax arrears and other terms necessary for understanding the whole principle of tax execution. The thesis focuses on the legal rules that regulate the tax execution. The next part of this work focuses directly on tax execution. It explains that tax execution can only be done in several ways and subject to certain conditions. The paper further describes the rights and obligations of the executor as the executing body. In the third chapter of this bachelor thesis, we find the stages of the enforcement proceedings including the protection of the obliged and the third parties. It also informs about the possibility to postpone or completely stop the tax execution. The most extensive chapter of this bachelor thesis is the fourth chapter, which describes the various forms of tax execution. These forms include tax execution by deductions from wages, by ordering a receivable from an account with a payment service provider, by ordering another monetary claim, by afflicting other property rights, and by selling movable and immovable property. In more detail, it deals with the auction, which is the main phase of this form of execution in the sale of movable property and real estate. In this paper we also find possibilities of defending the debtor. The conclusion of this work brings a practical examples which make it easier to understand this issue.
