Insurance fraud in property insurance

Abstract:

Diplomová práce se zabývá pojistnými podvody v pojištění majetku. V první kapitole je shrnutí základních pojmů z oboru pojišťovnictví. Přehled základních pojmů zjednoduší orientaci v dalších kapitolách, kde se budeme s nimi dále setkávat. Dále jsou zde definovány východiska a principy, kterými se pojišťovny řídí a slouží k předcházení vzniku pojistných podvodů. V druhé kapitole je vysvětlena problematika pojistných podvodů v návaznosti na právní vymezení a výklad, a s tím související možnosti postihů proti subjektům, které se pojistných podvodů dopouštějí. V této části práce jsou také specifikovány nástroje pro řízení rizika podvodů, které pojišťovny v současnosti využívají v rámci prevence před možným vznikem pojistných podvodů. V třetí kapitole jsou znázorněny konkrétní příklady zjištěných pojistných podvodů, ze kterých bude patrné, jakým způsobem může pojistný podvod nastat a co je potřeba pro jeho odhalení provést. Pojistný podvod je zde uveden v rámci pojištění věcí movitých, nemovitých a také případ pojistného podvodu interního. Čtvrtá kapitola se věnuje problematice spolupráce mezi pojišťovnami a třetími stranami v současnosti a navazuje na poslední část práce, kde je uvedena případová studie s návrhy řešení, který by současné nedostatky v komunikaci těchto třetích stran mohly zlepšit, a to především s Policií ČR, hasičským záchranným sborem a Českým hydrometeorologickým ústavem.

Abstract:

The thesis deals with fraudulent claims in property insurance. In the first chapter is a summary of basic concepts for the insurance sector. The basic concepts overview will simplify the orientation in next chapter that we are going to face. There are further define a possibilities and principles governing the insurance companies and serve to preceding formation of new fraudulent claims. In the second chapter is described the matter of fraudulent claims following legal delimitation and interpretation and it’s related choices of sanctions against entities which are involved in fraudulent claims. In this work part are also specified the instruments on risk frauds, which has been used by insurance companies at present as prevention against the potential creation of fraudulent claims. The third chapter shows concrete examples of found fraudulent claims, which shows the way how fraudulent claims may come and shows what is need to reveal it. The fraudulent claim is here listed under movable and immovable insurance and also the case of internal fraudulent claim. The fourth chapter is currently devoted to the issue of the cooperation between insurance companies and third parties and is linked with the last part of his work. In the last part of this work is listed case study with some solution proposal, which could be improve current shortcomings in the communication with these third parts, especially with the police of the Czech Republic, the fire brigade and Czech Hydrometeorological Institute
