Ombudsman - his function, position and perspective

Abstract:

Práce se zabývá aktuálním vývojem působnosti veřejného ochránce práv se zaměřením na to, jak se nové působnosti, jež mu jsou svěřovány, liší od jeho původního poslání a jaký mohou mít dopad na některé dosud nezpochybňované teze vztahující se k ochránci. Dospívá tak k závěru, že ochránce v některých případech vykonává určitou míru veřejné moci a může ukládat sankce v pravém slova smyslu a že je možné nalézt pravidla, která limitují jeho volnou úvahu. Dále v ní navazují úvahy, do jaké míry je možné jeho činnost přezkoumat, a to především soudně. Nabízí i jiný pohled na povahu ochránce jako monokratického orgánu a analyzuje, zda by měl být zakotven v Ústavě České republiky a jaký je jeho vliv na soudnictví.

Abstract:

The thesis focuses on the current development of the scope of authority of the Public Defender of Rights, mainly on how their new tasks change the original role of the institution and which impact these tasks have on so far unchallenged opinions about the Defender. Its conclusions are that the Defender sometimes exercises the power of authority and can impose sanctions and that rules limiting their consideration can be found. Then the thesis deals with issues whether the activity of the Defender can be reviewed (mainly by courts). It also presents new opinions on the Defender as a monocratic body and analyses if they should be regulated by the Constitution and their influence on the judiciary.
