Protection of competitor against unfair competition in the Czech Republic

Abstract:

Bakalářská práce se zabývá problematikou nekalé soutěže a ochranou proti ní. Práce se věnuje vymezení nekalousoutěžního jednání obsažené v generální klauzuli a úpravou skutkových podstat nekalé soutěže. Dále podává přehled o základních prostředcích ochrany proti nekalé soutěži. Na analýze dotazníkového šetření ukazuje, jaké je povědomí respondentů o druzích nekalosoutěžního chování, jaký má na ně nekalá soutěž vliv a zda vědí, jak se proti nekalé soutěži bránit. V teoretické části je obsažena definice toho, jaké jednání je považováno za nekalou soutěž a výčet a charakteristika jejích skutkových podstat. Dále je zde uveden přehled prostředků ochrany proti nekalé soutěži. Teoretická část rovněž analyzuje, jaký má nekalá soutěž dopad na tržní prostředí. Praktická část obsahuje analýzu dotazníkového šetření. Dotazníkové šetření zkoumá, jaké mají respondeti povědomí o tom, které jednání je možné podřadit pod nekalou soutěž a jak je nekalá soutěž ovlivňuje. Rovněž má za cíl zjistit, zda dotazovaní vědí, jak se lze proti nekalé soutěži bránit. Výsledky šetření ukazují, že respondenti jsou převážně schopni uvést konkrétní příklad nekalosoutěžního jednání a mají přehled o tom, jaké základní prostředky lze proti nekalosoutěžně jednajícímu soutěžiteli použít.

Abstract:

The bachelor thesis deals with the issue of unfair competition and protection against it. The thesis deals with the definition of unfair competition contained in the general clause and the adjustment of the facts of unfair competition. It also provides an overview of the basic means of protection against unfair competition. The analysis of the questionnaire survey shows the respondents' awareness of the types of unfair competition, what effect unfair competition has on them and whether they know how to defend themselves against unfair competition. The theoretical part contains a definition of what conduct is considered as unfair competition and a list and characteristics of facts of unfair competition. The following is an overview of the means of protection against unfair competition. The theoretical part further analyzes the impact of unfair competition on the market environment. The practical part contains an analysis of the questionnaire survey. The questionnaire survey examines the answer to which awareness of what actions can be classified as unfair competition and how unfair competition affects them. It also aims to find out if respondents know how to defend themselves against unfair competition. The results of the survey show that the respondents are mostly able to give a specific example of unfair competition and are informed of what basic means can be used against an unfair competitor.
