International licensing agreements from the perspective of the conflict of laws

Abstract:

This dissertation thesis focuses on the analysis of international licensing agreements from the perspective of conflicts of law-rules. The International License Agreement is closely linked to the intellectual property right. The dissertation thesis examines 2 fundamental areas: the demonstration of public law and the interest of the state in the conflict of law affecting the license agreement and simultaneously analysis of the conflict rules of the Rome Regulation I. In the introductory chapters the thesis focuses on the basic principles of the modification, rights and state interest in the area under review, followed by a chapter on qualifications. The main research source is the Rome I Regulation, its conflict rules, the public order reservation and imperative norms.

Abstract:

Táto dizertačná práca sa zameriava na analýzu medzinárodných licenčných zmlúv pohľadom kolízneho práva. Medzinárodná licenčná zmluva je úzko naviazaná na právo duševného vlastnícvta. Práca sa preto zaoberá dvomi základnými rovinami, a to skúmaním prejavov verejného práva a záujmu štátu v kolíznom práve dopadajúcom na licenčnú zmluvu a zároveň analýzou kolíznych noriem Nariadenia Rím I. V úvodných kapitolách sa práca zameriava na základné princípy úpravy, podobu licenčnej zmluvy a prejavy verejného práva a štátneho záujmu v skúmanej oblasti, po nich následuje kapitola venovaná kvalifikácii. Hlavným skúmaným prameňom je Nariadenie Rím I, jeho kolízne normy, výhrada verejného poriadku a imperatívne normy.
