House Arrest, its Execution and Control

Abstract:

Tato bakalářská práce je zaměřena na trest domácího vězení. Jedná se o alternativní trest zejména k trestu odnětí svobody. Do našeho právního řádu byl trest domácího vězení zaveden novým trestním zákoníkem s účinností od 1.1.2010. Práce obsahuje stručnou charakteristiku alternativního trestání. Těžiště práce spočívá na rozboru právní úpravy trestu domácího vězení, kdy je kladen důraz na problematické aspekty trestu spojené s jeho výkonem a kontrolou. Je zmíněna funkce Probační a mediační služby a její zapojení do výkonu trestu domácího vězení. Práce také podává informaci o průběhu a současné situaci související se zavedením elektronického monitoringu. Součástí práce je i porovnání české právní úpravy trestu domácího vězení s právní úpravou evropských zemí, které tento trest v nějaké formě uplatňují. Cílem práce je charakteristika trestu domácího vězení. Rozbor jeho legislativní úpravy s uvedením průběhu jeho výkonu a kontroly. Práce vyúsťuje ve zhodnocení právní úpravy včetně provedených změn novelou trestního zákoníku a uvádí vlastní náměty de lege ferenda.

Abstract:

This thesis is focused house arrest. This is an alternative punishment in particular imprisonment. Into our law the sentence under house arrest introduced new criminal law with effect from 1.1.2010. The work contains a brief description of alternative punishment. The thesis focuses on the analysis of the legislation of house arrest, where the emphasis is on the problematic aspects of punishment associated with its execution and control. The function of the Probation and Mediation Service and its involvement in the sentence under house arrest. This work also provides information on the progress and current situation related to the introduction of electronic monitoring. Part of this work is the comparison of the Czech legislation of house arrest with the legislation of European countries that this punishment in some form in place. The aim of the work is characteristic of house arrest. Analysis of the legislative amendments, stating during his performance and control. The work culminates in the evaluation of regulatory changes, including the amendment of the Criminal Code, and states own ideas de lege ferenda.
