Abstract:

Rigorózní práce se zabývá problematikou eutanázie, asistované sebevraždy a s nimi souvisejícími trestnými činy proti životu. Je členěna do jednotlivých kapitol, z nichž prvních šest je věnováno právě otázce eutanázie a asistované sebevraždy. Zabývám se zde mimo jiné i zahraniční legislativní úpravou nejen členských států EU, kde je eutanázie či asistovaná sebevražda povolena, a následně se věnuji rozboru nejzásadnějších rozhodnutí Evropského soudu pro lidská práva týkající se dané tématiky. Po zhodnocení průzkumu názoru české populace na danou problematiku a představení návrhů zákonů o důstojné smrti předložených v minulých letech, popisuji a analyzuji ty trestné činy proti životu, které souvisejí s tématem eutanázie a asistované sebevraždy. Zaměřuji se nejprve na obecnou charakteristiku vybraných trestných činů proti životu, nechybí ani kategorizace typických forem a způsobů páchání takových trestných činů, podrobný rozbor vybraných trestných činů proti životu či pojmů, které jsou pro ně zásadní. Rovněž jsou zmíněny příklady z judikatury, popsány přitěžující a polehčující okolnosti, přičemž závěr práce je věnován srovnání české právní úpravy vybraných trestných činů proti životu se slovenskou právní úpravou, kdy je vycházeno jak z právních předpisů, tak z komentářové literatury či judikatury soudů.

Abstract:

The rigorous thesis deals with the topic of euthanasia, assisted suicide and related crimes against life. It is divided into individual chapters of which the first six chapters concern the question of euthanasia and assisted suicide. In this part of the thesis I dealt with a foreign legislation of not only member states of the EU, where euthanasia and assisted suicide are legal. Then the attention is focused on the most crucial judgements of the European Court of Human Rights concerning this topic. After evaluation of the survey of the point of view of the Czech society on the topic of euthanasia and assisted suicide and presentation of the drafts of the laws on dignified death, I analyzed those crimes against life, which are related to the topic of euthanasia and assisted suicide. First the attention is paid to the general characteristic of the chosen crimes against life, then the categorization of the typical manners of committing such crimes is performed. After that a detailed analysis of the chosen crimes against life is performed. I also mentioned some of the case-law related to the chosen crimes against life and analyzed the extenuating circumstances and aggravating circumstances. The conclusion of the thesis focuses on the comparison of Czech and Slovak legislation regarding the chosen crimes against life. In this place, I came out from the legislation, case-law and a commentary literature.
