The Pitfalls of Litigation Against a Sovereign State

Abstract:

Státní imunity se staly jednou z nejzajímavějších oblastí mezinárodního práva. O státních imunitách by se dalo hovořit jako o průniku mezinárodního práva veřejného a soukromého, právě díky tomuto průniku jsou státní imunity tak zajímavým a zároveň kontroverzním tématem. Jedná se také o oblast, která zůstala většině neodborné veřejnosti neodhalená. I přes skutečnost, že státní imunita může zcela znemožnit soudní řízení či jeho výkon, se tento institut netěší zdaleka tak vysoké úrovni odborných publikací či komentářů jako ostatní, méně zásadní oblasti mezinárodního práva. Při zabývání se touto specifickou oblastí je potřeba brát ohled na mnohé aspekty, ať již to jsou mezinárodní a vnitrostátní úpravy, mezinárodně-obchodní či geopolitická situace a v neposlední řadě také možné zájmy aktérů, kteří přicházejí se státní imunitou do styku. Tito aktéři jsou vzhledem k povaze obchodních vztahů s cizími státy převážně velké mezinárodní společnosti a spory vyplývající z takovýchto obchodních vztahů pak představují obrovské hodnoty a dotýkají se zajímavých a palčivých témat. Tato práce pracuje s nejaktuálnějším děním, které se na scéně státní imunity odehrává, jak v podobě stavu jednotlivých kodifikací, tak právě ostatními faktory, mající na tuto oblast vliv.

Abstract:

The law of state immunity has become one of the most interesting and diverse areas of international law. State immunity could be described as public international law penetrating into private international law, which is probably the main reason behind the interesting yet controversial nature of state immunities. State immunity is also an area of law, that to a large degree remains unknown to the unprofessional public. Despite the fact that state immunity is capable of ceasing almost any proceeding or put their execution to a halt, the law of state immunity still does not enjoy the number of publications or commentaries as other areas of international law of lesser importance. While dealing with issues surrounding state immunities, various aspects have to be taken into consideration, be it international or national regulations, situation in international trade, geopolitics or interests of parties concerned by state immunity. The parties concerned, due to the nature of commercial relations with foreign state, are for the most part international companies and disputes arising of these relations represent great monetary values and are touching some very controversial topics. This publication works with the most recent developments on the state immunities stage in form of state of codifications or other factors having influence on this area.
