Constitutional Complaints

Abstract:

Bakalářská práce na téma „Ústavní stížnosti“ je zaměřena na ústavní soudnictví vykonávané prostřednictvím Ústavního soudu České republiky, které zajišťuje ochranu ústavnosti a v rámci něhož je subjektu práva umožněno využít specifický procesní prostředek ochrany ústavně zaručených práv a svobod. Stěžejním cílem práce je představit institut ústavní stížnosti, zejména pak význam ústavních stížností, náležitosti ústavních stížností, řízení Ústavního soudu České republiky o ústavních stížnostech a povahu a důsledky rozhodnutí Ústavního soudu. Výsledkem práce je provedená analýza institutu ústavní stížnosti, jakož i řízení o ústavní stížnosti a závěrem je popisováno rozhodování Ústavního soudu České republiky o ústavních stížnostech.

Abstract:

The bachelor´s dissertation themed “Constitutional complaints” is focusing on the constitutional judiciary carried out by the Constitutional Court of the Czech Republic. The constitutional judiciary guarantee the protection of the constitutionality and under the terms of the constitutional judiciary is the subject of law allowed to use the specific procedural means of the constitutionally guaranteed rights´ and liberties´ protection. The principal aim of the dissertation is to introduce the institute of the constitutional complaint, particularly the significance of the constitutional complaints, requisites of the constitutional complaints, the proceeding of the Constitutional Court of the Czech Republic of the constitutional complaints and the character and consequences of the Constitutional Court´s decision. The result of the dissertation is a conducted analysis of the institute of the constitutional complaint as well as the proceeding of constitutional complaint. In conclusion there is described the decision-making of the Constitutional Court of the Czech Republic about constitutional complaints.
