Banking from the Point of View of Legal Regulation

Abstract:

Diplomová práce je zaměřena na regulaci v oblasti bankovnictví v České republice. Cílem práce je charakterizovat regulaci a dohled bank z pohledu právní úpravy. Práce se zabývá vývojem bankovní regulace od roku 1990 do současnosti a zaměřuje se také na vývoj Basilejských dohod. Práce zahrnuje charakteristiku bankovního systému, jsou zde zmíněny důvody pro regulaci a také některé argumenty proti ní. Práce popisuje povinnosti, které musí banka plnit, aby mohla podnikat v oblasti bankovního sektoru. V rámci dohledu nad bankami jsou zmíněny zátěžové testy, kterými Česká národní banka testuje finanční trh z hlediska odolnosti vůči vybraným rizikům a dávají tak představu o stabilitě celého finančního trhu a jeho sektorech včetně bankovního. Regulace v bankovnictví je v posledních několika letech hodně diskutované téma, jsou zaváděna stále nová pravidla a povinnosti, které musí banky dodržovat, ale je důležité, aby tato opatření neměla negativní vliv na fungování samotné banky.

Abstract:

Diploma thesis is focused on the regulation of banking in the Czech Republic. The aim of the work is to characterize the bank regulation and supervision from the perspective of legislation. Thesis deals with the development of bank regulation from 1990 to the present and focuses on the development of Basel Accords. Furthermore, the work includes characteristics of bank system, it discusses the reasons for the regulation, as well as some arguments against it. Thesis describes responsibilities that has to be fulfilled by the banks so that they would be able to run a business in the bank sector. Stress tests are mentioned within the bank supervision, and used by Czech National Bank to test the financial market in terms of resistance against selected risks and therefore give an idea about the stability of the whole financial market and its sectors, including banking. Regulation in the banking sector has been a much discussed topic in the last few years, new rules and obligations are still being introduced that banks have to comply with, but it is important for these measures not to negatively affect the functioning of the bank itself.
