Abstract:

Tato diplomová práce se zabývá rolí státního zástupce v trestním řízení. Cílem této práce je zhodnocení současné právní úpravy, upravující roli státního zástupce v trestním řízení. Zaměřuji se především zařazení státního zastupitelství do systému dělby moci, jednotlivým institutům, které státní zástupci mají v trestním řízení a právní úpravou, která je obsažena v zákoně o státním zastupitelství, včetně možností novelizace. Diplomová práce je rozdělena na čtyři části. První kapitola se nazývá Postavení a struktura státního zastupitelství, zde je kladen důraz na institut dohledu v soustavě státního zastupitelství, dále na zařazení státního zastupitelství v systému dělby moci, včetně porovnání se zahraniční úpravou. Důležitá je zde též problematika novelizace zákona o státním zastupitelství. Druhá kapitola se nazývá Role státního zástupce v přípravném řízení. Zde se zabývám především dozorem, který státní zástupce vykonává nad přípravným řízením. Třetí kapitola se nazývá Role státního zástupce při řízení před soudem. Zde je řešena otázka jaká je role státního zástupce při hlavním líčení, při podávání opravných prostředků a při využívání institutu dohody o vině a trestu. Čtvrtá kapitola se nazývá Mezinárodní justiční spolupráce, zde je řešena především problematika evropského vyšetřovacího příkazu a úřadu veřejného evropského žalobce. V závěru kritizuji zařazení státního zastupitelství do moci výkonné a navrhuji debatu o změně tohoto stavu. Zároveň kritizuji současné snahy o novelizaci, které podle mého názoru dostatečně neřeší problémy s nezávislostí státního zastupitelství. Zároveň upozorňuji na problémy, které souvisí se zdlouhavým postupem při uskutečňování mezinárodní právní pomoci.

Abstract:

This thesis deals with the role of the public prosecutor in criminal proceedings. The aim of this thesis is to evaluate the current legislation governing the role of the public prosecutor in criminal proceedings. I focus mainly on the inclusion of the public prosecutor's office in the system of separation of powers, the individual institutes that public prosecutors have in criminal proceedings and the legal regulation contained in the law on the public prosecutor's office, including the possibilities of amendments. The diploma thesis is divided into four parts. The first chapter is called "The position and structure of the public prosecutor's office". Here, the emphasis is on the institution of supervision in the system of the public prosecutor's office. Furthermore, the inclusion of the public prosecutor's office in the system of separation of powers, including a comparison with foreign regulations. The issue of amending the Law of Public Prosecutor's Office is also important. The second chapter is called "The role of the public prosecutor in preliminary proceedings". Here I am primarily concerned with the supervision that the public prosecutor performs over the preliminary proceedings. The third chapter is called "The role of the prosecutor in proceedings in front of the court". This part answers the question of what is the role of the public prosecutor in the main trial, in the submission of remedies and in the use of the plea agreement institute. The fourth chapter is called "International judicial cooperation". This is primarily the issue of the European investigation warrant and the European public prosecutor's office. At the end of the thesis, I criticize the inclusion of the public prosecutor's office in the executive power and propose a debate on changing this status. Furthermore, I criticize the current efforts to amend of the Law of Public Prosecutor's Office, which, in my opinion, do not sufficiently solve the problems with the independence of the public prosecutors. At the same time, I draw attention to the problems related to the lengthy procedure in international legal assistance.
