Abstract:

V průběhu dějin si každé lidské společenství vytváří systém, jak reagovat na nedodržování svých základních hodnot a norem, a tím zajistit bezpečnost svých členů, plynulý chod společnosti a její další vývoj. Instituce trestu se tak stává nedílnou součástí života všech společností. První část této bakalářské práce se zabývá pojmem trestu, jeho účelem a jednotlivými funkcemi trestání, a to s přihlédnutím k současně prosazovaným trendům a názorům na tuto problematiku. Během historického vývoje došlo k výraznému posunu od pojetí trestu jako pouhé sociální msty (retributivní přístup) k zohledňování dalších funkcí, které by měl trest naplňovat (utilitární teorie). Lze sem řadit individuální a generální prevenci páchání trestné činnosti prostřednictvím odstrašení; eliminaci nebezpečných pachatelů; nápravu, resocializaci a snahu o zařazení pachatelů zpět do společnosti; a rovněž odstranění následků trestného činu – odškodnění oběti a úpravu narušených společenských vztahů. Tyto funkce trestání jsou hodnoceny z hlediska jejich přínosu k naplňování hlavního účelu trestního práva – ochrany společnosti před trestnou činností. Prosazování všech těchto funkcí, byť v omezeném rozsahu, nachází i v dnešní společnosti své uplatnění. Jako značný přínos lze hodnotit současné začleňování prvků restorativní justice do právních řádů jednotlivých států. Druhá část práce je zaměřena na účel a zásady trestání prosazované v České republice a vybraný okruh problémů, které s nynějším stavem v oblasti trestání neoddělitelně souvisí. Jelikož požadavky na účel trestu a prostředky jeho dosahování se projevují i v nárocích na trestněprávní úpravu a v ní obsažený systém sankcí a pravidel jejich ukládání, zabývám se zde zhodnocením platné i připravované kodifikace trestního zákona. K významným změnám posledních let patří zakotvování institutů restorativní justice a širší uplatňování alternativních sankcí a postupů, jež jsou pro pachatele méně závažné trestné činnosti či prvopachatele příležitostí k aktivnímu řešení svého pochybení bez následné stigmatizace odsouzením a negativních následků výkonu trestu odnětí svobody. Naplňování účelu trestů a jejich vyšší účinnosti zatím do značné míry brání formální i materiální překážky. Aby systém trestních sankcí mohl plnit úlohu efektivního prostředku k ochraně společnosti před kriminalitou, je třeba vždy pečlivě rozlišovat mezi typy pachatelů a volit tresty plnící adekvátní funkce. Předpokladem optimálního výběru řešení v konkrétní trestní věci je pak důkladné zhodnocení všech významných okolností trestného činu a osoby pachatele.

Abstract:

This work named „The Concept and Purpose of the Punishment - Actual situation in the Czech Republic“ deals with the purpose and particular functions of punishing with a special emphasis on the contemporary situation in the Czech Republic. Every human society creates certain system of methods how to react on situations, when their basic norms and values are violated and its own existence threatened. First part of the paper is focused on general attitudes of a society towards punishing offenders of criminal activities and theories dealing with functions of penal sanctions are outlined. Visible progression of opinions related to punishment can be observed as new elements are gradually entering the system of punishment. From primeval, mostly cruel punishments as a revenge for breaking the norms and rules of the society (retributive function), through exclusion of the offender from the society (elimination), individual and general determent, modern society came to punishments aiming at rehabilitation and resocialization of the offenders and to restitutive function, centred on compensation of damages caused by the criminal offence. These approaches are evaluated in light of its benefits to the pursuance of the main purpose of the penal law - protection of society against criminal acts. In my opinion also nowadays there are reasons to assert all these functions. Punishment shall contain only certain minimal level of repressive measures and mainly offer the opportunity for rehabilitation to offender. Preventative function resulting from determent can not be marginalized as well. On the other hand the policy of punishment should enable disciplinary action against highly socially dangerous perpetrators. Also incorporation of restitutive function into the criminal justice system means substantive contribution for modern society. However application of punishments should always be derived from thorough understanding of concrete case and functions and aims, which are pursued by the imposition of the sentence. Opinions on punishments reflect the cultural and economic level of the society and its attitudes towards human rights and freedoms. The development of purpose of punishment in the Czech Republic corresponds to the above mentioned trends. Rehabilitation and re-education of the offender is predominantly preferred function of punishment, the concept of restorative justice is also pursued recently. This leads to a broader assertion of alternative sanctions and alternative methods of solution of criminal cases imposed primarily to young offenders, first-time offenders or people accused of less serious delicts. As the imprisonment bears many negative effects, which actually prevents it from fulfilling intended functions, nowadays various kinds of alternative sanctions applying principle of restorative justice are used, for instance probation, community service and financial penalty. With regard to the anticipated changes of the Czech criminal law, some of these sanctions are described. However certain formal and material problems are connected with implementation of these institutes. It is essential to provide an institution which would take over organization and enforcement of alternative punishments – Probation and Mediation Service was established for this purpose in the Czech Republic. Due to its activity acceleration and simplifying of criminal procedure can efficiently occur. As the development has brought many positive changes, I assume contemporary system of punishing as relatively satisfactory and asserted principles of restorative justice, alternative sanctions, institution of Probation and Mediation Service and other alternative ways as useful. However there are still matters to improve in Czech criminal justice, this supports the tendency to recodify the criminal code and implement other new institutes.
