Offence of failure to divert employer deductions made to employees

Abstract:

Tato bakalářská práce se zabývá trestným činem, a to neodvedení provedených srážek zaměstnavatelem zaměstnancům. Práce pojednává o vyhledání a poznání nedostatků v právní úpravě a následné doporučení. Cílem práce bude analyzovat právní úpravu jak z teoretického ale i praktického hlediska. První kapitola definuje samotný trestný čin. V druhé kapitole jsou rozděleny jednotlivé druhy pracovních smluv a srážky z nich, ve třetí kapitole jsou konkrétní odvody a srážky z mezd popsány. Dále se budeme v práci věnovat státním organizacím které na odvody dohlíží. V páté kapitola poukazuje na možné postihy zaměstnavatelů. Předposlední kapitola řeší předcházení a zamezení tohoto trestného činu. Poslední kapitola je aktuální a reflektuje zásah pandemie COVID-19 a státní program Antivirus. V práci byla použita metoda analýzy. Použita byla odborná literatura v platné legislativě. Bylo zjištěno že právní úprava je propracovaná, prošla vývojem a zlepšením, ale v současnosti jsou trestní sankce relativně nízké.

Abstract:

This bachelor's thesis deals with the crime, namely the non-payment of deductions made by the employer to employees. The thesis deals with the search for and knowledge of shortcomings in the legislation and subsequent recommendations. The aim of the work will be to analyze the legislation from both a theoretical and practical point of view. The first chapter defines the crime itself. In the second chapter, individual types of employment contracts and deductions from them are divided, in the third chapter, specific levies and deductions from wages are described. Furthermore, we will focus on state organizations that oversee levies.the fifth chapter points out possible sanctions of employers. The penultimate chapter deals with the prevention of this crime. The last chapter is current and reflects the intervention of the COVID-19 pandemic and the state program Antivirus. Method of analysis was used in this work. Professional literature, valid legislation was used. At present, criminal sanctions are relatively low.
