Value added tax and it's application to taxable persons

Abstract:

The aim of the hereby submitted diploma work is the analysis of the basic characteristics of the value added tax and its application on taxable persons. We have focused on the economic and legal basis of the taxes, where we expressed the general importance and function of the taxes in the organization of a state. Later, we have continued by special attention to the establishment of the value added tax into the tax system of the Slovak Rebuplic. For its further development we have analyzed the correspondence of the basic principlex and the basic characteristics of the taxation with the special characteristics of taxation by the value added tax. In order to give a true picture of VAT, its content and depth of its application, we have focused on the formation of three mechanisms of VAT operation, and that under conditions of special relations of VAT´s operation inland (Slovak Republic), further of the mechanism of VAT operation, of the intra-community relations between the EU member states and in the third case of the mechanism of VAT operation outside of EU meber states, i. e. in relation to the third countries of the world and the members states of EU.

Abstract:

Cieľom predkladanej práce je analýza základných znakov dane z pridanej hodnoty v procese jej aplikácie na zdaniteľné osoby. Zamerali sme pozornosť na ekonomicko-právnu podstatu daní, kde sme vyjadrili všeobecný význam a poslanie daní v organizácii štátu. Pokračovali sme osobitnou pozornosťou na zavedenie dane z pridanej hodnoty do daňového systému Slovenskej republiky. Pre jej ďalší rozvoj sme analyzovali súlad základných princípov a základných znakov zdaňovania so špeciálnymi znakmi zdanenia pri dani z pridanej hodnoty. Na vystihnutie významu dane z pridanej hodnoty, obsahu a hĺbky pôsobenia sme upriamili pozornosť vo formovaní troch mechanizmov fungovania dane z pridanej hodnoty, a to v podmienkach osobitných vzťahov pôsobenia dane z pridanej hodnoty v rámci tuzemska (SR), potom v mechanizme fungovania dane z pridanej hodnoty v rámci intrakomunitárnych vzťahov medzi štátmi EÚ a v treťom prípade ako mechanizmus fungovania DPH mimo štátov EÚ, čiže vo vzťahu medzi tretími štátmi sveta a členskými krajinami EÚ.
