Legal aspects of the fight against international terrorism from the point of view of the protection of human rights

Abstract:

The main aim of the bachelor thesis is to examine the issue of victims of terrorism, the international law covering them and to analyse the nature of their legal status. A sub-objective of the thesis is to examine the relationship between international terrorism and human rights and to analyse what is the impact of the fight against terrorism on human rights. The opening chapters discuss the concepts of public international law, terrorism and human rights. These are the key concepts of this thesis and they are interrelated. The next chapter focuses on the controversial relationship between international terrorism and human rights. The last chapter analyzes the legal status of victims of terrorism and discusses the international law instruments of selected international organizations that regulate the status and protection of victims of terrorism. The aim of the thesis is to highlight the paradoxical relationship between international terrorism and human rights and to present the current international legal framework dealing with the status of victims of terrorism and to outline the possibilities for future developments within international law.

Abstract:

Hlavným cieľom bakalárskej práce je preskúmať problematiku obetí terorizmu, ďalej medzinárodneprávnu úpravu, ktorá sa nimi zaoberá a analyzovať povahu ich právneho postavenia. Dielčím cieľom práce je preskúmať vzťah medzinárodného terorizmu a ľudských práv a analyzovať aký je dopad boja proti terorizmu na ľudské práva. V úvodných kapitolách sú rozobraté pojmy medzinárodné právo verejné, terorizmus a ľudské práva. Ide o kľúčové pojmy tejto práce, ktoré sú vzájomne previazané. Ďalšia kapitola sa sústreďuje na kontroverzný vzťah medzinárodného terorizmu a ľudských práv. Posledná kapitola analyzuje právne postavenie obetí terorizmu a rozoberá medzinárodneprávne inštrumenty vybraných medzinárodných organizácií, ktoré upravujú postavenie a ochranu obetí terorizmu. Zámerom práce je poukázať na paradoxný vzťah medzinárodného terorizmu a ľudských práv a priblížiť súčasnú medzinárodneprávnu úpravu zaoberajúcu sa postavením obetí terorizmu a načrtnúť možnosti budúceho vývoja v rámci medzinárodného práva.
