Exeptional and Life Punishment in the Czech Republic

Abstract:

Práce se zabývá historickým a současným pohledem na výkon trestu doživotí a výjimečných trestů. Pokouším se bez předsudků pojmenovat problematiku výkonu těchto trestů, a to jak v rovině teoretické, tak empirické. Obsah je rozčleněn do čtyř kapitol, z nichž každá se věnuje samostatné problematice výjimečného trestu. První tři kapitoly popisují teorii, právní náhledy a možnosti práce s touto specifickou skupinou vězněných osob. Snahu pochopit myšlení a přístup odsouzených osob a na straně druhé vnímat náročnost práce vězeňského personálu s osobami ve výjimečných trestech. Zmiňuji složitost cílů a motivaci u této skupiny odsouzených, ale také frustraci personálu dlouhodobě se pohybujícím v tomto negativním prostředí. Poměrně rozsáhle popisuji bezpečností prvky, systémy eskort a negativní jevy s tím spojené. Ve své práci se snažím upoutat pozornost k výkonu těchto trestů, k trestům tolik nepopulárním a mediálně skloňovaným. Nedílnou součástí mé práce je dotazníkový průzkum mezi doživotně odsouzenými, kterého se zúčastnilo 30 z celkového počtu 40 doživotně odsouzených. Otázky a odpovědi jsou vyhodnoceny formou grafického a tabulkového znázornění. Jsem přesvědčena, že se jedná o objektivní a vypovídající vzorek doživotně odsouzených osob.

Abstract:

The diploma thesis deals with the historical and current perspective of life imprisonment and exceptional sentences. Without prejudice I try to identify the issue concerning the execution of these sentences both in terms of theoretical and empirical point of view. The content is divided into four chapters. Each of them is focused on a separate part of exceptional punishment. The first three chapters describe the theory, legal views and possibilities of work with this specific group of prisoners. On one hand the work describes the efforts to understand the thinking and attitudes of inmates and on the other hand it tries to understand seriousness of the work with persons sentenced to exceptional sentences. I mention the complexity of goals and motivation of this group of prisoners but also the frustration of long-term personnel working in this negative environment. I quite extensively describe the security measures, escort systems and associated negative phenomena. In my work I try to draw attention to the execution of these punishments - to such unpopular sentences often reflected in media. An integral part of my work is a questionnaire survey among life-sentenced prisoners filled in by 30 of total 40 persons sentenced to life imprisonment. Questions and answers are evaluated by graphical and tabular representation. I am convinced that it is an objective and representative sample of people sentenced for life.
