Abstract:

Diplomová práce na téma "Trestný čin maření spravedlnosti" se zabývá analýzou a hodnocením právního institutu maření spravedlnosti jakožto jednoho z klíčových trestných činů v rámci trestního práva. Maření spravedlnosti představuje závažný delikt, který zasahuje do samotného jádra právního systému a ovlivňuje jeho fungování. Cílem této diplomové práce je provést komplexní analýzu trestného činu maření spravedlnosti, jeho definice, rysů a prvků. Práce se zaměřuje na identifikaci důvodů, proč jednotlivci nebo organizace podnikají kroky vedoucí k maření spravedlnosti, a na zhodnocení účinnosti trestního zákonodárství při potírání tohoto deliktu. Trestný čin maření spravedlnosti představuje závažný aspekt trestního práva, který brání dosažení spravedlnosti, narušuje její principy a podkopává důvěru v právní řád. Diplomová práce se v tomto ohledu zaměřuje na důkladnou analýzu tohoto deliktu z různých perspektiv, přičemž klade důraz na historické, skutkové, systémové a aplikační souvislosti v tuzemsku i v mezinárodním kontextu. Práce rovněž analyzuje dopady maření spravedlnosti na společnost a na důvěru občanů v právní systém. Výsledkem této diplomové práce je hluboké porozumění trestnímu činu maření spravedlnosti a jeho komplexnímu kontextu v právním systému.

Abstract:

The master thesis on the topic "The crime of obstruction of justice" deals with the analysis and evaluation of the legal institute of obstruction of justice as one of the key criminal offences in the framework of criminal law. Obstruction of justice is a serious offence that strikes at the very core of the legal system and affects its functioning. The aim of this thesis is to conduct a comprehensive analysis of the crime of obstruction of justice, its definition, features and elements. The thesis focuses on identifying the reasons why individuals or organisations take actions leading to obstruction of justice and assessing the effectiveness of criminal legislation in tackling this offence. The offence of obstruction of justice is a serious aspect of criminal law that impedes the achievement of justice, undermines its principles and undermines confidence in the rule of law. In this respect, the thesis focuses on a thorough analysis of this offence from different perspectives, emphasising the historical, factual, systemic and applied contexts, both domestically and internationally. The work also analyses the impact of obstruction of justice on society and on citizens' trust in the legal system. This thesis results in a deep understanding of the crime of obstruction of justice and its complex context in the legal system.
