Insolvency proceedings and position of insolvency administrator in individual phases of insolvency proceedings

Abstract:

Diplomová práce se zabývá insolvenčním řízením a postavením insolvenčního správce v jeho jednotlivých fázích. Cílem diplomové práce je prozkoumat průběh insolvenčního řízení a postavení insolvenčního správce založené na konkrétním příkladu z praxe. Diplomová práce ověří tři hypotézy, které jsou stanovené v úvodu práce. Autorka hodnotí změny zákonů, které vstoupily v platnost a mění zákon č. 182/2006 Sb., o úpadku a způsobech jeho řešení (insolvenční zákon), ve znění pozdějších předpisů. Pozornost je věnována i konkrétnímu příkladu právnické osoby, která se ocitla v insolvenčním řízení, kde je nejen představena role, povinnosti a činnosti insolvenčního správce, ale i průběh reorganizace. Závěr diplomové práce obsahuje i vlastní názory autorky.

Abstract:

The diploma thesis deals with the insolvency proceedings and the position of the insolvency administrator in individual phases of insolvency proceedings. The aim of this diploma thesis is to investigate the process of insolvency proceedings and the position of the insolvency administrator based on a concrete example. The diploma thesis will verify three hypotheses, which are specified in the introduction of the thesis. The author evaluates the amendments to the laws that came into force and amends Act No. 182/2006 Coll., On Bankruptcy and the Methods of Resolution (Insolvency Act), as amended. Attention is also focused on a concrete example of a legal person who has been in insolvency proceedings, where is not introduced only the role, duties and activities of the insolvency administrator, but it is introduced also the process of the reorganization. The conclusion of the diploma thesis also contains the author's own view.
