Abstract:

Předkládaná práce se snaží uchopit terorismus jakožto specifickou trestnou činnost, kterou je nutno postihovat ve všech jejích projevech, přičemž se snaží především poukázat na to, že při postihu terorismu je nutné posuzovat důkladně nejen samotné trestné jednání – tj. konkrétní útok pachatele, ale i úmysl či účel, za kterým pachatel teroristický útok páchá. Za tímto účelem práce nabízí pojetí terorismu v celé jeho šíři – představuje jeho vývoj v historii, jeho projevy, jeho příčiny a další okolnosti, které mohou mít na jeho páchání vliv. Součástí tohoto vymezení je i rozbor právní úpravy, a to nejen na úrovní práva národního, ale rovněž práva mezinárodního a práva EU, neboť definice obsažena v trestním zákoníku právě z těchto mezinárodních předpisů vychází. V poslední části práce je stručně představena mezinárodní justiční spolupráce v trestních věcech a je krátce uvažováno o tom, jakou formu spolupráce je možné využít při postihu terorismu. Práce si klade za cíl posoudit, zda je úprava v českém trestním právu dostatečná a zda je možné podle ní terorismus postihovat efektivně či nikoli.

Abstract:

This thesis aims to look at terrorism as a specific crime that has to be punished in all its manifestations, while trying mainly to point out that when punishing terrorism, it is necessary to thoroughly evaluate not only the crime itself — i. e. the specific attack of the perpetrator, but also its intention or purpose for which the perpetrator commits the terrorist attack. The aim of this text is to offer the concept of terrorism in all its entirety — it presents its development in history, its manifestations, its causes and other circumstances that may affect its commitment. Also an analysis of legislation, not only on the level of national law, but also international law and EU law is part of this characterization, as the definition contained in the Criminal Code is based on these international regulations. The last part of the thesis briefly describes international judicial cooperation in criminal matters and also briefly speculates about a form of cooperation that can be used in punishment of terrorism. The thesis aims to assess whether the regulation in Czech criminal law is sufficient and whether it is possible to punish the terrorism effectively according to it or not.
