Collision of the legal obligation of informed consent of the patient with the doctrine of constitutional protection of public health in the light of Supreme Courts case law

Abstract:

Samotným jádrem výzkumu je hledání odpovědi na naši výzkumnou otázku, zdali je pojetí právní doktríny ochrany veřejného zdraví (tzv. OVZ) absolutní a to právě ve smyslu krizové (bezprecedentní) situace ohrožení veřejného zdraví. Míra absolutnosti čili absolutnost právní doktríny ochrany veřejného zdraví bude zkoumána v kontextu provádění (vy)nucených lékařských zákroků (pozornost bude věnována zejm. právním aspektům povinné, resp. (vy)nucené vakcinace jakožto typickému příkladu zásahu do tělesné integrity jednotlivce) na lidských bytostech a to konkrétně proti jejich vůli a to bez ohledu na svobodný a informovaný souhlas (tzv. SIS) těchto lidských bytostí (jedná se tedy o de facto poměřování mechanismů a síly OVZ vs. SIS, např. v kontextu implementace očkování, na pozadí tzv. "medical emergency", tj. výjimečných situací). Za těmito cíli bude přiblížena a analyzována právní konstrukce zákonné povinnosti informovaného souhlasu pacienta a per analogiam se obdobně budeme zabývat i vymezením ústavní doktríny ochrany veřejného zdraví. Jádro výzkumu je zaměřeno na posouzení toho, jak se soudy nejvyšších instancí vypořádávají s tímto střetem (OVZ vs. SIS), z čehož budeme vyvozovat onu míru absolutnosti právní doktríny ochrany veřejného zdraví. Vědecký výzkum se pohybuje, kromě roviny teoretické, i v rovině dotazníkových šetření, ze kterých plynou některá velmi zajímavá dílčí zjištění, zejm.: potvrzení kontroverznosti povinných lékařských zákroků; nevhodnost současné právní úpravy; extrémní znepokojení nad současnými vývojovými trendy v oblasti ochrany veřejného zdraví. Prostor je věnován i krátké reflexi událostí let minulých a uvedení prognóz 2 možných budoucích alternativních vývojových trendů, z nichž první se bude ubírat cestou paradigmatu tzv. BIO-SECURITY STÁTU (přenesení těžiště zdravotních otázek směrem k OVZ a utvrzení její dominance) a druhá potencionální vývojová alternativa spočívá v přijetí tzv. BIO-FREEDOM ACCORDS (spočívající v návratu k dominanci SIS, implementaci čl. 7 odst. 3 LZPS, skrze který SIS obdrží status plnohodnotného základního lidského práva posíleného o ochranné mechanismy čl. 9 odst. 2 ÚČR a ius naturalistické obranné mechanismy Radbruchovy doktríny, otevírajícího cestu 5. generaci lidských práv v kontextu de lege ferenda).

Abstract:

The very core of the research is the search for an answer to our research thesis, whether the concept of the legal doctrine of public health protection (the so-called OVZ) is absolute and that so precisely in the sense of a crisis (unprecedented) public health threat situation. The degree of absoluteness, i.e. the absoluteness of the legal doctrine of public health protection, will be examined in the context, or with regard to the performance of forced medical procedures (attention will be paid in particular to the legal aspects of compulsory, respectively of forced vaccination as a typical example of interference with the bodily integrity of an individual, or the sphere of his inviolability) on human beings, specifically against their will, regardless of the free and informed consent (the so-called SIS) of these human beings (this is therefore a de facto measurement of the mechanisms and strength of the OVZ vs. SIS, e.g. in the context of the vaccination implementation, in the background of the so-called "medical emergency", i.e. exceptional situations). In pursuit of these goals, the legal construction of the legal obligation of the patient's informed consent will be specified and analyzed, and per analogiam we will similarly deal with the definition of the constitutional doctrine of public health protection. The core of the research is focused on assessing, how the courts of the highest instances deal with this conflict (OVZ vs. SIS), from which we will derive the degree of absoluteness of the legal doctrine of public health protection. Scientific research includes, in addition to the theoretical level, also the level of questionnaire surveys, from which some very interesting partial findings flow, in particular: confirmation of the controversy of compulsory medical procedures; inadequacy of current legislation; extreme concern about current development trends in the field of public health protection. Part of our research is also dedicated to a short reflection of the events of the years past and the introduction of a prognosis of 2 possible future alternative development trends, the first of which will follow the path of the so-called BIO-SECURITY STATE paradigm (transferring the bulk of the health issues towards the OVZ and confirming its dominance) and the second potential development alternative consists of the adoption of the so-called BIO-FREEDOM ACCORDS (consisting of the return to the dominance of the SIS, the implementation of Art. 7, Par. 3 LZPS, through which the SIS will receive a status of a full-fledged basic human right strengthened by the protective mechanisms of Art. 9, Par. 2 ÚČR and ius naturalistic defense the mechanisms of the Radbruch doctrine, paving the way for the 5th generation of human rights in the context of de lege ferenda).
