Analysis of differences in the position of some french departements in the system of French public administration

Abstract:

A system of French public administration is built on three administrative levels: region, department, and municipality. These territorial units don't create an integrated structure of public administration only in mainland France, but also in extensive overseas area, falling under the French administration. Despite the fact that every territorial unit has a legal precisely defined its position and powers, there are also territorial units, which constitute an exception in terms of their status and extent of their powers, authorized to carry within their administrative territory. Primarily, it relates to overseas territorial units which, because of their specific character, are not part of classic structure of public administration. The aim of the thesis is to introduce differences in the position of some of the territorial units of the basic French model of fiscal federalism, and define impacts, respectively factors, in the genesis of these differences involved.

Abstract:

Systém francúzskej verejnej správy je postavený na troch základných administratívnych úrovniach: región, departement, obec. Dané územné celky však netvoria iba ucelenú štruktúru verejnej správy v rámci metropolitného Francúzska, ale aj rozsiahleho zámorského územia, spadajúceho pod francúzsku správu. Napriek tomu, že každý územný celok má zákonom presne vymedzené svoje postavenie a právomoci, vo francúzskom prostredí existujú aj územné celky, ktoré tvoria výnimku, čo sa týka ich štatútu a rozsahu ich kompetencií, ktoré sú oprávnené vykonávať v rámci svojho administratívneho teritória. Jedná sa predovšetkým o zámorské územné celky, ktoré svojím špecifickým charakterom nespadajú do klasickej štruktúry verejnej správy. Cieľom diplomovej práce je tak predstaviť odlišnosti v postavení niektorých územných celkov od základného modelu francúzskeho fiškálneho federalizmu a definovať vplyvy, resp. faktory, ktoré sa na vzniku týchto odlišností podieľali.
