The Comparing of the Legal Relation of the EC Law and National Law of the Member States with the Legal Relation of the Federal and State Law in the USA

Abstract:

V mé diplomové práci s názvem „Komparace poměru komunitárního a vnitrostátního práva členských států ES/EU s poměrem federálního a státního práva USA“ se snažím nejprve zmapovat poměr komunitárního a národního práva členských států ES/EU, poté vymezit poměr federálního a státního práva v USA, přičemž se opírám jak o historický vývoj, tak o judikaturu. V konečné fázi potom oba systémy komparuji. Zejména posuzuji oba poměry a v jejich vzájemných souvislostech se je pak snažím od sebe odlišit, ukázat prvky těmto poměrům společné a také nakolik vykazují v poměru ke Spojeným státům země ES/EU znaky federalismu. Pokouším se poukázat na to, že federalismus není charakteristickým jen pro USA, ale že jeho prvky lze spatřovat i na úrovni států Evropského společenství.

Abstract:

In my thesis called „the Comparison of the legal relation of the EC/EU law and national law of the Member states with the legal relation of the federal and state law in the USA“ I try to analyze the relation of the community law and the national law of the member states, then define the relation of the federal law and the state law in the United states, whereas I rely on historical developement and crucial case law. In the end I compare both systems. I try to evaluate both relations and differ them in the mutual connection, showing the elements which are common to these relations and also to what extent the EC/EU member states show the features of the federalism in relation to the United States. In this thesis I want to try, in particular, to notice that the federalism is not the characteristic feature only for the USA, but that its elements can be seen also on the level of the European Community states.
