The review of a measure of a general nature

Abstract:

Tématem rigorózní práce je přezkum opatření obecné povahy. Institut opatření obecné povahy je využíván v řadě oblastí správního práva, například ve stavebním právu, právu životního prostředí, při regulaci provozu na pozemních komunikacích či ochraně veřejného zdraví. U takto široce uplatňované formy správní činnosti bylo potřeba zajistit ochranu práv jejích adresátů. Ochranu před eventuálními vadami opatření obecné povahy zajišťuje zejména přezkum opatření obecné povahy podle správního řádu a podle soudního řádu správního. Předmětem rigorózní práce je správní i soudní přezkum opatření obecné povahy. Práce je zaměřena na aktuální právní úpravu, jakož i na její vývoj. V práci je kladen důraz na judikaturu, která podobu přezkumu opatření obecné povahy zásadně dotvářela. Rigorózní práce shrnuje ta nejzásadnější soudní rozhodnutí či rozhodnutí jinak zajímavá. Taktéž upozorňuje na změny v právní úpravě, na nedostatky právní úpravy, na sporné otázky spojené s danou problematikou a na jejich řešení poskytnutá soudy či právní teorií.

Abstract:

The subject of the rigorous thesis is the review of a measure of a general nature. A measure of a general nature is used in many areas of administrative law, for example in construction law, environmental law, road traffic regulation or public health protection. For such a widely applied activity of public administration, it was necessary to ensure the protection of the rights of its addressees. Protection against possible defects in a measure of a general nature is ensured in particular by the review of the measure of a general nature. The subject of the rigorous thesis is the review of measures of a general nature carried out by administrative authorities and courts. The thesis focuses on the current legislation as well as its development. The thesis focuses on the case law that has fundamentally shaped the form of review of measures of a general nature. This thesis provides a summary of the most important or otherwise interesting decisions. The thesis draws attention to the shortcomings of the legal regulation, to the controversial issues related to the review of measures of a general nature and to their solutions provided by the courts or legal theory.
