Relationship between Czech Law and EU Law in the Jurisprudence of the Czech Constitutional Court

Abstract:

Práce se zabývá vztahem práva Evropské unie a českého práva v judikatuře Ústavního soudu České republiky. Z důvodu výsadního postavení českého Ústavního soudu je při interpretaci tohoto vztahu rozbor příslušné judikatury jedním z důležitých kroků k uchopení této složité problematiky. V úvodu práce je zdůvodněn výběr tématu, cíle a metody práce. Na úvod navazuje druhá kapitola, která pojednává o pramenech práva tak, že vymezuje nejdůležitější pojmy této materie. Jádrem práce je její třetí kapitola. Jedná se o rozbor vztahu českého a komunitárního práva, českého a unijního práva a problematiky předběžné otázky. Kapitola obsahuje rovněž poznámku o naší suverenitě v rámci evropské integrace.

Abstract:

This thesis deals with the relationship between the European Union and the Czech law in the jurisprudence of the Constitutional Court of the Czech Republic. Due to the privileged position of the Czech Constitutional Court according to the interpretation of the relationship mentioned above the analysis of the certain jurisprudence is one of the most important steps to be able to grasp this complicated issue. In the introduction there is a reason of choosing the main theme of the thesis, the purpose of the thesis and the working methods. The introduction is followed by the second chapter which deals with the sources of law by explaining the important terms of this substance. The core of the thesis is the third chapter. It is an analysis of the relationship between the Czech and Community law, between the Czech and Union law and the analysis of the issue of preliminary ruling. The chapter also contains a note on our sovereignty within the frame of European integration.
