The Possibilities of Protection of Person in Criminal Procedure

Abstract:

Diplomová práce zpracovaná na téma „Možnosti ochrany osoby v trestním řízení“ je zaměřená na zjištění možností ochrany osob, kterými jsou institut utajeného svědka podle § 55 odst. 2 trestního řádu, zvláštní ochrana svědka podle zákona č. 137/2001 Sb. o zvláštní ochraně svědka a dalších osob v souvislosti s trestním řízením a o změně zákona č. 99/1963 Sb., občanský soudní řád, ve znění pozdějších předpisů a krátkodobá ochrana osob podle § 50 zákona č. 283/2008 Sb., o Policii ČR, ve znění pozdějších předpisů. Cílem diplomové práce je proniknutí do problematiky ochrany osob v trestním řízení a zjištění podmínek, za kterých je osobě umožněna tato ochrana. Dalším cílem je zanalyzovat právní úpravu týkající se možnosti poskytnutí této ochrany od jejího vzniku v právním řádu České republiky do současné doby společně s vyjádřením úvah de lege ferenda. Základním účelem trestního řízení je v souladu se zákonem odhalit pachatele skutku, který naplňuje znaky trestného činu podle hmotného trestního práva, vyšetřit tento skutek a postavit pachatele před soud, který rozhodne o jeho vině či nevině, v případě, že ho shledá vinným, uloží mu trest nebo ochranné opatření (nebo obojí), popřípadě upustí od potrestání, a zajistí výkon trestu i ochranného opatření, pokud byly uloženy.

Abstract:

The Diploma thesis deals with the possibilities of a personal protection in the frame of criminal procedure. It’s specially covering the following options (legal institutes) of the protectionlike institute of the protected witness program according Sec. 55 Subcscetion 2 of on Criminal Procedure Code andthe special protection program of the witness according to Act No. 137/2001 Coll., On the special protection program for the witness and other persons in context of criminal investigation in amendments of the Act No. 99/1963 Coll., Civil Court procedure Code as amended until the day this Act came into effect. The short-term protection program according Sec. 50, Act No. 283/2008 Coll., On Police of The Czech republic, as amended until the day this Act came into effect is the part of the thesis as well. The main goal of the paperwork is to understand the issues of special personal protection within the limits of criminal procedure and to find out the requirements for providing the protection.Another goal of the thesis is to analyze the legal aspects of providing the special personal protection program since the time the first acts went into the force in the Czech Republic up to the current state together with the statement of considerations de lege ferenda. The fundamental purpose of the criminal procedure is to detect a crime and aperpetrator, investigate the crime according the law and proceed the case before the court. The court only can decide about the guilty, innocence and following punishment or protective measures etc. The court itself is also in charge of the executive part of the criminal procedure.
