The bodies of association in the law system of the Czech republic

Abstract:

Diplomová práce se zabývá současnou úpravou práva spolků v České republice dle zákona 89/2012 Sb. a ve Švýcarsku dle švýcarského občanského zákoníku. Konkrétně je práce zaměřena na orgány spolku. V první části je popsán historický vývoj spolkového práva a spolkové činnosti na našem území - základní principy občanské společnosti. Následně se práce věnuje založení a vzniku spolku, organizaci a fakultativním orgánům spolku, institutu členství dle současné české právní úpravy a následně je v témže rozsahu rozebráno švýcarské spolkové právo. Ve druhé části je provedena komparace obou systémů. V práci jsou popsány spolky v užším pojetí, jakožto nástupci občanských sdružení, tedy právnické osoby založené na samosprávném a dobrovolném principu, jejichž činnost směřuje k naplňování účelu spolku a jež jsou definovány občanským zákoníkem.

Abstract:

The diploma thesis deals with the current regulation of association law in the Czech Republic according to Act 89/2012 Coll. and in Switzerland according to the Swiss Civil Code. Specifically, the work is focused on the bodies of the association. The first part describes the historical development federal law and federal activities in our territory - the basic principles of civil company. Subsequently, the work deals with the establishment and formation of the association, organization and faculty bodies of the association, the institute of membership according to the current Czech legislation and subsequently Swiss federal law is discussed to the same extent. The second part is done comparison of both systems. The thesis describes associations in a narrower sense, as successors civic associations, i.e., legal entities based on self government and voluntary principles, the activities of which are aimed at fulfilling the purpose of the association and which are defined Civil Code.
