Legal Aspects of the Transformation of Institutional Care for People with Mental Disabilities

Abstract:

Bakalářská práce je zaměřena na problematiku transformace sociálních služeb poskytovaných lidem s mentálním postižením. Cílem práce je jednak dokázat, že komunitní způsob poskytování podpory je lepší než poskytování péče v ústavu, a jednak popsat proces transformace ústavní péče na péči komunitní. Úvodní část je věnována sociálním službám a jejich místu v systému sociálního zabezpečení, a také specifikům mentálního postižení a jejich projevům v právních vztazích. V další kapitole je popsán život v ústavu a v komunitně poskytované službě, pozornost je věnována právu na nezávislý způsob života a vymezením pojmů transformace a deinstitucionalizace. Závěrečné části jsou věnovány procesu transformace. Nejprve jsou popsány fáze procesu, jejich obsah a zapojení subjektů, a dále je popsán možný budoucí vývoj v oblasti transformace sociálních služeb.

Abstract:

This bachelor thesis focuses on how to transform social services that are provided to people with mental disabilities. The primary aim of this work is to prove that community-based methods of providing support are better than the care provided institutionally. A secondary aim of this work is to describe an effective process of transition from institutional to community-based care. The introduction of this thesis deals with how social services relate to the current system of social welfare, while also examining the specifics of mental disability as well as the legal implications. Institutional life and community-based services are described in the next chapter. Attention is paid to the subject's right to an independent way of life. Also examined are the notions of transformation and deinstitutionalisation. The concluding section deals with the process of transformation; beginning with the various phases of the process, including their content and participation of subjects, and concludes with a prognosis of how the future transformation of social services is likely to develop.
