Interrogation as a criminalistic method

Abstract:

Předmětem bakalářské práce je výslech – chápán jako kriminalistická metoda. Práce reaguje na současný systém vyšetřování, u kterého je výslech prakticky základním procesním úkonem. Praktická realizace výslechu je však z veliké části problematická. Důvodů je víc, ale nejvýznamnější jsou nedostatečná odborná úroveň vyšetřovatele, nízká etická úroveň osobnosti vyšetřovatele, hrubé procesní chyby, zastaralá formulace trestního zákona a v neposlední řade i nesprávné chápání výslechu jako kriminalistické metody na jedné straně a současně i jako procesního úkonu. Práce dokumentuje základní atributy výslechu, ale jako svůj hlavní cíl má zaměření na chyby v metodice výslechu, ale taky na procesní postup při výslechu jako procesním úkonu. Práce je výsledkem analýzy vlastních znalostí, ale hlavně praktického hlediska za pomoci kvalitativního výzkumu.

Abstract:

The subject of the bachelor’s thesis is interrogation – understood as a criminological method. The work responds to the current systém of investigation, in which interrogation is practically a basic procedural act. However, the practical implementation of the interrogation is largely problematic. There are many reasons, but the most importatnt ones are the insufficient professional level of the investigator, the low ethical level of the investigator’s personality, gross procedural errors, the outdated formulation of the criminal law and, last but ot least, the incorrect understanding of the interrogation as a forensic method on the hand as a procedural act at the same time. The thesis documents the basic attributes of interrogation , but as its main goal it focuses in errors in the methodology of the interrogation, but also on the procedural procedure during the interrogation as a procedura act. The work is te result of analysis of one’s own knowledge, but mainly from a practical point of view with the help of qualitative research.
